About modification and amendments in the Law "About Audiovisual Media"

Article 1. State Item 10 of part 1 of article 3 of the Law of July 16, 2020 to No. ZR-395 "About audiovisual mass media" (further - the Law) in the following edition:

"10) the distributor of audiovisual programs - the physical person or legal entity providing audiovisual programs for distribution to the operator based on the written agreement reached with person having property rights;".

Article 2. State article 9 of the law in the following edition:

"Article 9. Prohibition on abuse of audiovisual transfers

1. It is forbidden in audiovisual transfers:

1) distribution of information calling for violent overthrow of the constitutional system or the war encouraging or justifying such actions;

2) distribution of information containing promotion of violence and cruelty;

3) distribution of the information kindling national, racial, sexual or religious hatred, and also sowing, encouraging or justifying discrimination on signs of age, disability or other personality or social characteristics;

4) distribution of pornography based on article 300 of the Criminal code of the Republic of Armenia;

5) distribution of appeals to the penal or other actions prohibited by the legislation;

6) broadcast of the movies and audiovisual programs containing promotion of criminal subculture, except as specified, provided by part 4 of article 9 of this Law.

2. In case of violation of the prohibitions established by part of 1 this Article, except for Item 4, during live broadcast, the speaker does not bear responsibility if violation it was warned or declared during live broadcast, and in case of further violation the live broadcast stops.

3. The regulatory state agency in case of identification of signs of the act prohibited by the criminal code of the Republic of Armenia during implementation of the control functions assigned to it by the law addresses to competent authorities.
