About creation of the regulating base for some categories of public organizations

The Parliament adopts this organic law.

Article 1. Regulation subject

This law establishes procedure for creation, the organization and functioning of the public organizations created by the Government, bodies of local public authority and local public authority of special level, except for public organizations in the field of education, researches, health care in the social sphere, in the field of culture (theaters, circuses and the concert organizations, the museums and libraries), youth and sport which activities are regulated by other laws.

Article 2. Public organization

(1) the Public organization is the legal entity of the public law acting in the mode of the public power, created for the purpose of accomplishment of function of the state and administrative and territorial units on provision of public services in the field of competence of the founder of the relevant organization or function in program implementation and the projects of development including financed from external sources, and not performing business activity.

(2) for the purposes of this law the public services provided by public organizations are services of general/local meaning which have no economic nature, do not interfere with the competitive market and are intended for satisfaction of public interest in fields of activity of the Government, bodies of local public authority or local public authority of special level.

(The public services provided by public organizations do not include 3) for the purposes of this law, without being limited to it, the public services provided according to the Law on regulation of business activity by permission No. 160/2011, public services, delivered by municipal services, determined by the Law on public services of municipal services No. 1402/2002, the post services determined by the Law on mail service No. 36/2016, of service of electronic communications, determined by the Law on electronic communications No. 72/2025, of public transport service, service in the financial sphere (bank and non-bank).

(4) Public organization has no right to exercise functions of normative legal regulation, supervision and the state control in areas for which bodies of public management are responsible, functions according to the edition of allowing documents and to enable other activities assuming the realization of prerogatives of the public power determined by article 3 of the Law on the state position and the status of the government employee No. 158/2008.

Article 3. Procedure for creation of public organization

(1) the Public organization is created by the Government according to the offer of bodies of the central public management by approval of the order of the Government, and also bodies of local public authority and local public authority of special level of decision path of authorized body of local public authority / approval of the resolution of Executive committee of Gagauzia.

(2) Functions of the founder of the public organization created by the Government are performed by the State office, the ministry or other central administrative authorities.

(3) Functions of the founder of the public organization created by bodies of local public authority or local public authority of special level are performed by authorized body of local public authority or respectively Executive committee of Gagauzia.

(4) Creation of public organization is preceded by carrying out the analysis of the impact which is part of the explanatory note to the draft of the resolution to the Government/draft decision of authorized body of local public authority / to the draft of the resolution of Executive committee of Gagauzia on creation of public organization.
