About procedure for capture by customs authorities of tests or samples of goods, and also procedure for their customs research

According to Item 7 of Article 298 of the Customs code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES:

1. Determine that:

1.1. sampling or samples of goods is made by the official of customs authority in the location of goods concerning which operations of customs control are performed, according to methods of sampling or is exemplary, certain international and (or) state standards (GOST, ISO and others), the methodical recommendations developed on their basis and is drawn up by the act of sampling or samples of goods, the form, procedure for filling and which use are determined by the State Customs Committee taking into account item 4 of Article 298 of the Customs code of the Republic of Belarus.

In necessary cases sampling or samples of goods can be made using technical means and involvement of the expert and (or) specialist according to Articles 304 and 305 of the Customs code of the Republic of Belarus;

1.2. tests or samples of goods undertake in the minimum quantities sufficient for carrying out researches and providing possibility of their separation into two equal parts:

analytical - used for the actual research;

control - intended for such research in case of contest by the interested person of results of primary research.

Each of two parts of test or sample of goods:

it is supplied with the label in form according to appendix 1;

it is packed and sealed up by the method excluding access to such test or sample without violation of packaging and (or) seal, except as specified, when test or sample can be identified by other acceptable method.
