About introduction of amendments to the Law on safety management of road infrastructure No. 350/2023

This law partially shifts parts (1), (3), (4) and (5) Article 1; Items 1 and 1b Article 2; parts (1) - (3) and (6) Article 5; part (3) Article 6; part (1) articles 6a; article 6e; part (1a) Article 9 and part (1) articles 11a of the Directive 2008/96/EU of the European parliament and Council of November 19, 2008 about safety management of the road infrastructure published in the Official magazine of the European Union by L 319 of November 29, 2008, CELEX: 32008L0096, with the last changes made by the Directive (EC) 2019/1936 of the European parliament and Council of October 23, 2019.

Art. I. - In the Law on safety management of road infrastructure No. 350/2023 (The official monitor of the Republic of Moldova, 2023, Art. No. 474-476, 842) to make the following changes:

1. In Article 1:

part (to add 1) with Item e) the following content:

"e) estimates of road safety at the level of all road net.";

add Article with parts (2-1) and (2-2) following of content:

"(2-1) This law are applied also to highways and projects of road infrastructure which do not fall under action of part (2) and are located outside urban areas, do not service the real estate objects adjoining to them and are implemented with use of financing of the European Union, except for the highways which are not intended for general movement of vehicles, such as bicycle paths and also the highways which are not intended for general traffic such as access roads to industrial facilities or to agricultural or forest holdings.

(2-2) This law are not applied to highways in tunnels more than 500 meters long, without prejudice to the provisions concerning the joint checks in the field of traffic safety provided by part (1-1) Article 10.".

2. Add Article 2 with the concept "trans-European road network" of the following content:

"trans-European road net - the national road infrastructure which is part of trans-European transportation network.".
