About modification of some legal acts of the Kyrgyz Republic concerning the notification of persons state bodies by means of service of the guaranteed delivery of messages

Bring in the Administrative Procedure Code of the Kyrgyz Republic (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2017, No. 1 (2), the Art. 13) the following changes:
1) in Article 104:
a) state parts 1 and 2 in the following edition:
"1. Participants of administrative process are informed by court on time and the place of judicial session or carrying out separate legal proceeding by means of the service of the guaranteed delivery of messages allowing to fix the direction fact court and receipts of the notice by the addressee.
In case of the lack of technical capability or data necessary for the direction of the notice by means of service of the guaranteed delivery of messages, the notice goes by means of the SMS message, e-mail or other similar forms of the telecommunications allowing to fix the fact of the direction and receipt of the corresponding notice by the addressee.
At the same time the surname and position of person who transferred this text, method of implementation of the notice, date and time of its transfer and also surname and position of person which accepted it are specified copies of the transferred text which remains in court and is filed.
If the notice is directed by means of service of the guaranteed delivery of messages, it is considered handed through the specified service and makes sure digital record about it.
The procedure for functioning of service of the guaranteed delivery of messages, and also the directions, deliveries and fixings of notifications (notices, the agenda, documents) by means of the specified service is determined by the Cabinet of Ministers of the Kyrgyz Republic.
If the notice is handed to the addressee or his representative directly in court or in the place of its stay, such delivery is performed on receipt.
