This law establishes measures for prevention of introduction and distribution of invasive alien types for the territory of the Republic of Moldova, decrease in their impact on biodiversity, ecosystems and ecosystem services, and also on management of them by regulation of competences of responsible bodies and obligations of physical persons and legal entities.
For the purposes of this law the following concepts are used:
1) biodiversity - variety of live organisms in all ecosystems, including trans-species, intraspecific variety and variety of ecosystems;
2) disease of animals - origin at animal infections or infections with clinical or pathological manifestations or without that, caused by one or several pathogenic agents;
3) ways of introduction - methods and mechanisms by means of which invasive alien types get into new ecosystem and extend in it;
4) research - the descriptive or experimental activities performed in regulated conditions for the purpose of receipt of new scientific knowledge or new product development and technologies. It includes the initial stages of identification, the characteristic and isolation of the genes responsible for signs of invasive alien types, except for the signs determining invasiveness if they are essential to development of similar signs in noninvasive types;
5) preserving ex situ - preserving components of biodiversity outside their natural habitats;
6) control of population number - any lethal or non-lethal action applied to population of invasive alien types for the purpose of maintenance of number of individuals at the minimum level so that negative impact on biodiversity, ecosystem services public health or economy was minimized, including in situations when eradication of type is impossible;
7) early identification - identification and confirmation of presence of invasive alien type in certain territory before its wide circulation;
8) eradication of invasive alien types - complete and final elimination of population of invasive alien types by means of lethal or non-lethal means;
9) introduction of invasive alien types - movement of type out of limits of its natural area of distribution owing to intentional or accidental interference of the person;
10) isolation of invasive alien types - application of measures for creation of the barriers directed to decrease in risk of dispersion and distribution of invasive alien type out of limits of zone into which it already got;
11) prevention of introduction and management of invasive alien types - any lethal or non-lethal action aiming at eradication, control of the number of population or isolation of invasive alien type in case of minimization of impact on local types and their habitats;
12) wide circulation - process in case of which the invasive alien type goes beyond naturalization stage, having autonomous population, and considerably extends within the potential area of distribution where he can survive and breed;
13) ecosystem services - direct and indirect contribution of ecosystems to wellbeing of the person;
14) the isolated space - the controlled and protected installation zone intended for content of organisms in the conditions interfering their accidental release or distribution;
15) alien type - the live organism relating to type, subspecies or taxon of more low rank of animals, plants, mushrooms or microorganisms, purposely or the hybrid which is accidentally brought in the area which is outside the natural zone of distribution including any its viable part, such as gametes, seeds, eggs or other forms of reproduction, and also any, grade or breed who can survive and breed in the new circle;
16) invasive alien type - alien type, concerning introduction or distribution of which it is determined that it makes negative impact on biodiversity and the related ecosystem services, including on public health and/or economy;
17) the invasive alien type infringing on interests of the Union - invasive alien type which negative impact on biodiversity, ecosystem services, public health or economy proves acceptance and application of the coordinated measures at the European Union level;
18) the invasive alien type infringing on national interests - invasive alien type, other than the type infringing on interests of the Union concerning which based on the available scientific data and proofs it is determined that its introduction, release or distribution create or can create essential negative impact on biodiversity, ecosystem services, public health or national economy in all territory of the Republic of Moldova or on its part that requires acceptance of specific measures at the national level;
19) effective structure of the Information system of supervision - the organized set of institutional, human, technical and information resources providing the continuous, coordinated and operational functioning of the Information system of supervision, and also collection, check and bystry data transmission about emergence and distribution of invasive alien types, guaranteeing at the same time capability of early reaction and interdepartmental cooperation at the national and cross-border levels.
(1) This law is applied to all invasive alien types.
(2) This law is not applied:
a) to types which expand or change the natural area of distribution without intervention of the person;
b) to genetically modified organisms in the value determined by article 4 of the Law on regulation and control of genetically modified organisms No. 152/2022;
