About modification of the Criminal code of Ukraine concerning strengthening of responsibility for creation of electronic and communication fraudulent organized groups (fraudulent call centers) and attraction to participation in them

The Verkhovna Rada of Ukraine decides:

1. The criminal code of Ukraine (2001, Art. No. 25-26, 131) to add sheets of the Verkhovna Rada of Ukraine with Article 255-4 of the following content:

"Article 255-4. Creation, management of electronic and communication fraudulent organized group or participation in it

1. Creation of electronic and communication fraudulent organized group or management of such organized group or its structural part -

are punished by imprisonment for a period of seven up to twelve years with confiscation of property.

2. Participation in electronic and communication fraudulent organized group of person realizing illegal nature of activities of such organized group -

it is punished by imprisonment for a period of five up to ten years with confiscation of property or without that.

3. Provision of means, services, information and other assistance of activities of electronic and communication fraudulent organized group by person who realized illegal nature of activities of such organized group, but is not her participant, -

are punished by imprisonment for a period of five up to ten years with confiscation of property or without that.

4. Intentional involvement of other person to participation in electronic and communication fraudulent organized group or to assistance of its activities by job offer, remunerations, renderings of services or in a different way, and also distribution of information for the purpose of such attraction, commited by person, realizing illegal nature of activities of such organized group, -

are punished by imprisonment for a period of three up to five years with confiscation of property or without that.

5. The actions provided by part four of this Article are made repeatedly, -

are punished by imprisonment for a period of five up to ten years with confiscation of property.
