About modification and amendments in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 2, 2014 No. 862 "About approval of Rules of state registration and accounting of separate types of vehicles on vehicle identification number, training of drivers of motorized vehicles, acceptance of examinations and issue of car driver licenses"

I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 2, 2014 No. 862 "About approval of Rules of state registration and accounting of separate types of vehicles on vehicle identification number, training of drivers of motorized vehicles, acceptance of examinations and issue of car driver licenses" (registered in the Register of state registration of regulatory legal acts for No. 10056) the following changes and amendments:

in Rules of state registration and accounting of separate types of the vehicles on vehicle identification number approved by the specified order:

19) of Item 3 to state the subitem in the following edition:

"19) the certificate on introduction of utilization payment - the document confirming execution of expanded obligations by producers (importers) in which information is provided in electronic and digital form and is certified by means of the digital signature;";

state Item 16 in the following edition:

"16. For registration of vehicles, except for mopeds, their owners (representatives of owners) represent:

1) the identity document, in paper or electronic form by means of service of digital documents (for identification of the personality);

2) the documents confirming payment of the registration fee and the state fees for issue of SRTS, GRNZ provided by the Tax code of the Republic of Kazakhstan (further - the Tax code).

At the same time collection is paid for primary state registration of the motorized vehicle relating to vehicles for private use and belonging on right of possession, uses and (or) orders to physical person, stipulated in Item 2 articles 615 of the Tax Code:

concerning the vehicle imported on the territory of the Republic of Kazakhstan from the countries which are not entering into EEU - before release of such vehicle by customs authority in free circulation;

concerning the vehicle imported on the territory of the Republic of Kazakhstan from the countries entering into EEU - before its primary state registration in the Republic of Kazakhstan.

The diplomatic and equated to them representations of foreign state, consular establishments of foreign state accredited in the Republic of Kazakhstan and also their employees and members of their families are exempted from payment of collection for primary registration;

3) the certificate on introduction of utilization payment (in case of primary vehicle registration) issued according to the Rules of implementation of expanded obligations of producers (importers) approved by the order of the Government of the Republic of Kazakhstan of October 25, 2021 No. 763.

(In case of primary vehicle registration) the diplomatic and equated to them representations of foreign state, consular establishments of foreign state accredited in the Republic of Kazakhstan and also their employees and members of their families are exempted from provision of the certificate on introduction of utilization payment;

4) the electronic passport of the vehicle (the electronic passport of the vehicle chassis) (in case of primary vehicle registration) physical person, by means of digital system of the national operator (the national administrator) of system of electronic passports.

(In case of primary vehicle registration) the diplomatic and equated to them representations of foreign state, consular establishments of foreign state accredited in the Republic of Kazakhstan and also their employees and members of their families are exempted from provision of the electronic passport of the vehicle (the electronic passport of the vehicle chassis);

4-1) electronic passport of the vehicle (the electronic passport of the vehicle chassis) (in case of primary vehicle registration) the legal entity, by means of digital system of the national operator (the national administrator) of system of electronic passports.

The diplomatic and equated to them representations of foreign state, consular establishments of foreign state accredited in the Republic of Kazakhstan and also vehicles of Armed Forces, other troops and military forming of the Republic of Kazakhstan and on vehicles of special state bodies of the Republic of Kazakhstan are exempted from provision of the electronic passport of the vehicle (the electronic passport of the vehicle chassis) (in case of primary vehicle registration);

5) former SRTS and GRNZ (in case of their availability);

6) the order (order) of the legal entity on allocation and transfer of the vehicle to the structural division or other legal or physical person certified by seal of the legal entity (except for subjects of private entrepreneurship) if former vehicle owner was the legal entity;

7) the document confirming the property right to the vehicle, certified by the notary of the Republic of Kazakhstan or the EDS of former and new owners in case of making of registration actions by means of PTsP or digital objects or the purchase and sale agreement signed by results of realization of distrained property or the resolution of the legal executive on transfer to the claimant of personal estate in nature without realization;

8) the documents confirming passing of customs clearance (the customs declaration, the customs receipt order) (in case of primary vehicle registration, the EEU imported on customs area);

9) the certificate on vehicle compliance with the changes made to its design to safety requirements in form according to appendix 18 to the Technical regulation of the Customs union "About safety of wheel vehicles", to No. 877 approved by the decision of the Commission of the Customs union of December 9, 2011 (further - TR CU 018/2011) if changes before its registration are made to design of the vehicle;

10) the inspection report of the vehicle according to appendix 12 to these rules (in case of primary vehicle registration).";

add with Item 16-5 of the following content:

"16-5. For registration of trail car, being result of individual technical creativity, their owners (representatives of owners) represent:

1) the identity document, in paper or electronic form by means of service of digital documents (for identification of the personality);

2) the documents confirming payment of the registration fee and the state fees for issue of SRTS, GRNZ provided by the Tax code;

3) the test report issued by accredited test laboratory according to TR CU 018/2011;

4) the document on assignment of vehicle identification number issued by Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan;

5) safety construction certificate of the vehicle.";

"22-1. For vehicle identification obligatory survey of the vehicle is performed.

Survey of the vehicle is performed in case of:

1) primary vehicle registration, except as specified primary registration of the new vehicles made in the territory of the Republic of Kazakhstan or imported by official dealers of manufacturers of vehicles;

2) to replacement of body, chassis, vehicle frame;

3) change of color of the vehicle;

4) correction of discrepancy and (or) mistake in specifying of brand, model, identification number or number of the chassis (body, frame), years of release, color, amount, engine capacity, quantity of seats of the vehicle.";

"36. On the vehicles belonging to foreign participants of traffic GRNZ of the following series are issued:

"D" - on office and private vehicles of staff of the diplomatic representations accredited in the Republic of Kazakhstan, the international organizations and/or their representations, consular establishments registered in the Republic of Kazakhstan;

"T" - on office and private vehicles of administrative technicians of the diplomatic representations accredited in the Republic of Kazakhstan, the international organizations and (or) their representations, consular establishments registered in the Republic of Kazakhstan;

"NANOSECOND" - on office and the private vehicles of consular establishments headed by honourable consular officials;

"M" - on vehicles of branches and representations of the foreign legal entities registered in the territory of the Republic of Kazakhstan;

"N", "C", "L", "P", "J", "K", "S" and "Y" - on vehicles of the legal entities with foreign participation registered in the territory of the Republic of Kazakhstan;

"F", "T", "A", "G", "I", "N" and "R" - on vehicles of foreign citizens and stateless persons.

Participation in traffic of the vehicle with GRNZ of the series "D", "T", "HC" requires availability of the sticker issued by the organization for work with diplomatic corps.

Effective period of GRNZ of the series "D", "T", "HC" is equal to sticker effective period.";

"69-1. In case of the personal appeal of uslugopoluchatel (the representative of uslugopoluchatel) to the State corporation for receipt of the state service connected with vehicle registration, the employee of the State corporation within 20 minutes are performed:

identification of the identity of uslugopoluchatel (representative of uslugopoluchatel);

completeness check, and also reliability of the submitted documents and (or) these (data) containing in them;

verification of data on payment of the charges and the state fees established by the Tax code, introduction of utilization payment (in case of primary vehicle registration) through the corresponding digital systems of state bodies.

In cases of detection of mistakes or inaccuracies in the statement and (or) documents submitted by uslugopoluchatel, their discrepancies to requirements for form and content, the representations by uslugopoluchatel of incomplete document package specified in Item 10 of the List according to appendix 5 to these rules, the service provider adopts statements by means of the digital waiting list.
