This Law governs the public relations in the field of migration, establishes legal, organizational, economic and social basis of public administration and regulation of migratory processes in the Republic of Tajikistan.
In this Law the following basic concepts are used:
1) migration - irretrievable, temporary and seasonal change of the place of the accommodation by physical persons within the Republic of Tajikistan, from the Republic of Tajikistan abroad, from the abroad to the Republic of Tajikistan;
2) the migrant - physical person which changes the place of the accommodation by change of the state of permanent stay or movement in the republic on irretrievable, temporary or seasonal basis for the purpose of accommodation, implementation of labor and business activity, on family circumstances or other purposes;
3) internal migration - irretrievable, temporary, and also seasonal change of the place of residence of the citizen within the Republic of Tajikistan;
4) illegal migration - entry of foreign citizens or stateless persons into the Republic of Tajikistan or transit of such persons through the territory of the Republic of Tajikistan, stay or implementation of labor activity of such persons in the Republic of Tajikistan with abuse of regulations identified by the legislation of the Republic of Tajikistan;
5) border labor migration - labor activity of persons living in border areas in the territory of the adjacent state or in the Republic of Tajikistan on the basis of international treaties of the Republic of Tajikistan;
6) reintegration of migrants - set of the legal relations arising in implementation process of measures by means of which the migrant owing to certain period of stay abroad enters social and economic system of the country again;
7) repatriation - organized return of citizens of the Republic of Tajikistan and foreign compatriots to the Republic of Tajikistan in case of serious threats of their life and to health and in other cases established by this Law and international treaties recognized by Tajikistan;
8) labor migration - trip abroad of citizens of the Republic of Tajikistan, and also entry into the Republic of Tajikistan of foreign citizens and persons without citizenship for accomplishment of paid work according to employment, civil contracts and within business activity;
9) the labor migrant - the citizen of the Republic of Tajikistan who voluntarily and temporarily performs labor or other types of paid activities in the territory of foreign state, and also the foreign citizen or the stateless person performing voluntarily and temporarily labor or other types of paid activities in the territory of the Republic of Tajikistan;
10) diversification of labor migration - expansion of the directions of labor migration, the labor markets, professional spheres and forms of organized employment of labor migrants for the purpose of ensuring stability of migratory processes, protection of the rights of migrants and decrease in risks of dependence on certain host states;
11) members of the family of the migrant - person who is married to the migrant and also children and other persons who according to the current legislation of the Republic of Tajikistan or based on the international legal acts are recognized as members of the family of the migrant;
12) ecological migration - resettlement of citizens in the territory of the Republic of Tajikistan owing to emergence of danger of deterioration in state of environment to citizens or possible emergence of risks of environmental disasters;
13) employment agencies - the legal entities and individual entrepreneurs having according to the legislation of the Republic of Tajikistan license for activities on employment of citizens of the Republic of Tajikistan in foreign states and also foreign citizens and stateless persons in the territory of the Republic of Tajikistan;
14) quota for attraction of foreign labor power - certain number of foreign citizens and the stateless persons involved to the Republic of Tajikistan for implementation of paid labor activity for fixed term.
The legislation of the Republic of Tajikistan on migration is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan, and also the international legal acts recognized by Tajikistan.
