aiming at enhancement of legal regulation and fixing priority of rights and freedoms of man and citizen in the field of health protection,

these Bases establish the legal, organizational and economic principles in the field of protection of public health.

Section I. General provision

Article 1. Protection of public health

Protection of public health is set of the measures of political, economic, legal, social, cultural, scientific, medical, sanitary and hygienic and anti-epidemic nature directed to preserving and strengthening of physical and mental health of each person, maintenance of his long active life, provision to it medical care in case of loss of health.

The right to health protection according to the Constitution of the Russian Federation, the conventional principles and the international standards and international treaties of the Russian Federation, Constitutions (charters) of subjects of the Russian Federation is guaranteed to citizens of the Russian Federation.

Article 2. Basic principles of protection of public health

The basic principles of protection of public health are:

1) observance of rights of man and citizen in the field of health protection and providing the state guarantees connected with these rights;

2) priority of preventive measures in the field of protection of public health;

3) availability of the medico-public assistance;

4) social security of citizens in case of loss of health;

5) responsibility of public authorities and local government bodies, companies, organizations and organizations irrespective of pattern of ownership, officials for providing the rights of citizens in the field of health protection.

Article 3. Legislation of the Russian Federation on protection of public health

The legislation of the Russian Federation on protection of public health consists of relevant provisions of the Constitution of the Russian Federation and Constitutions (charters) of subjects of the Russian Federation, these Bases, other Federal Laws and federal regulatory legal acts, the laws and other regulatory legal acts of subjects of the Russian Federation.

Article 4. Tasks of the legislation of the Russian Federation on protection of public health

Tasks of the legislation of the Russian Federation on protection of public health are:

1) determination of responsibility and competence of the Russian Federation, subjects of the Russian Federation concerning protection of public health according to the Constitution of the Russian Federation and the Federal Laws, and also determination of responsibility and competence of local government bodies concerning protection of public health;

2) legal regulation in the field of protection of public health of activities of the companies, organizations and organizations irrespective of pattern of ownership, and also the state, municipal and private health care systems;

3) determination of the rights of citizens, separate national groups in the field of health protection and establishment of guarantees of their observance;

4) determination of professional privileges, obligations and responsibility of health and pharmaceutical workers, establishment of guarantees of their social support.

Section II. Powers of federal bodies of the government, public authorities of subjects of the Russian Federation and bodies local self-government in the field of health protection

Article 5. Powers of federal bodies of the government in the field of protection of public health

The following powers belong to powers of federal bodies of the government in the field of protection of public health:

1) acceptance and change of the Federal Laws and other regulatory legal acts of the Russian Federation in the field of protection of public health, supervision and control of their observance and execution;

2) regulation and protection of rights and freedoms of man and citizen in the field of protection of public health;

3) establishment and carrying out single state policy in the field of protection of public health, development and implementation of federal programs for health care development, prevention of diseases, to delivery of health care, sanitary and hygienic formation of the population and on other questions in the field of protection of public health;

4) the organization of rendering specialized medical care to citizens of the Russian Federation in federal specialized medical institutions which list affirms the federal executive body authorized by the Government of the Russian Federation;

5) the organization of delivery of health care, the Russian Federation provided by the Federal Laws for certain categories of citizens, including forming of the state task for rendering this help in the medical organizations according to the procedure, determined by the authorized Government of the Russian Federation federal executive body;

6) forming of the state task for rendering high-technology medical care to citizens of the Russian Federation in the medical organizations according to the procedure, determined by the Government of the Russian Federation;

10) organization of system of sanitary protection of the territory of the Russian Federation;

11) implementation of measures, the people directed to rescuing of life and protection of their health in case of emergency situations, informing the population on situation in zone of emergency situation and about the taken measures;

12) providing single technical policy in the field of the pharmaceutical and medical industry, approval of state standards of the Russian Federation, specifications on products of medical appointment, the organization of supervision of their observance;

13) establishment of standards of medical care, standards of equipment of the organizations of health care by the medical equipment and other federal standards in the field of health care;

14) confirmation of conformity (registration, testing and permission of application) medicinal and disinfectants, immunobiological medicines and products of medical appointment, strong and toxic agents, drugs, psychotropic substances, control of their production, turnover and of procedure for their use; confirmation of conformity of products, works and services;

15) the organization and control of compliance of quality of the provided medical care, quality medicinal and disinfectants, immunobiological medicines and products of medical appointment, strong and toxic agents, drugs, psychotropic substances, quality of donor blood and its components to the established federal standards in the field of health care (except for control ceded according to part one of Article 5.1 of these Bases for implementation to public authorities of subjects of the Russian Federation);

16) development and approval of the program of the state guarantees of rendering to citizens of the Russian Federation of the free medical care including the basic program of compulsory medical insurance;

17) establishment of single federal system of the statistical recording and reporting in the field of protection of public health;

18) development of single criteria and programs of training of health and pharmaceutical workers, determination of the nomenclature of specialties in health care and nomenclatures of the organizations of health care;

19) coordination of activities of public authorities, local government bodies, subjects of the state, municipal and private health care systems, other business entities in the field of protection of public health; health protection of family (maternity welfare, paternity and childhood);

20) establishment of procedure for the organization and production of medical examinations;

21) licensing of separate types of activity in the field of health care, except for the licensing of types of activity transferred according to part one of Article 5.1 of these Bases for implementation to public authorities of subjects of the Russian Federation;

22) establishment of procedure for creation and activities of committees (commissions) concerning ethics in the field of protection of public health;
