About release from the taxation of the money allocated for carrying out New Year's and Christmas holidays for children and for acquisition of children's festive gifts
This Law regulates some questions of financing of the actions connected with the organization of New Year's and Christmas holidays for children and teenagers as exception of the general provisions established by the Tax code of Ukraine.
Article 1. The amounts of funds which income tax payers of the companies transfer to public authorities, local government bodies, public (including trade-union) to the organizations and organizations of education, health care and culture created by them containing at the expense of means of the relevant budgets on carrying out New Year's and Christmas holidays for children and teenagers and on acquisition of children's festive gifts, are included gross expenses of such taxpayers in the amount of, not exceeding 4 percent of taxable profit of the preceding (reporting) period.
Article 2. Are exempted from the taxation by the transaction value added tax on sale by production and trade enterprises of children's festive gifts, and also tickets for New Year's and Christmas actions for the children who are purchased at the expense of Social Insurance Fund on temporary disability, trade-union committees of the companies and the organizations, other non-profitable organizations. At the same time the tax amounts paid by producers of children's festive gifts for acquisition of raw materials and materials for their production concern to structure of gross expenses and do not join in the tax credit.
Article 3. The cost of the festive gifts and tickets for New Year's and Christmas actions received by children according to this Law from the organizations and the organizations listed in article 1 of this Law does not join in the comprehensive taxable income of the citizens who are parents.
