approve the enclosed Procedure for determination of regulations of exit of products of conversion of natural diamonds and diamonds in the customs purposes.

Procedure for determination of regulations of exit of products of conversion of natural diamonds and diamonds in the customs purposes

1. This Procedure for determination of regulations of exit of products of conversion of natural diamonds and diamonds in the customs purposes (further - the Procedure) is developed according to Item 14 and Item 27 of the Regulations on import to the Russian Federation and export from the Russian Federation of natural diamonds and diamonds approved by the Presidential decree of the Russian Federation of November 30, 2002 N1373 "About Approval of the Regulations on Import to the Russian Federation and Export from the Russian Federation of Natural Diamonds and Diamonds" (The Russian Federation Code, 2002, N 49, Art. 4874; 2007, N 3, Art. 430).

2. This Procedure extends only to subjects of production of diamonds - the legal entities and individual entrepreneurs staying on the special registry in the bodies of federal assay supervision performing facet of natural diamonds for the purpose of production of diamonds (further - the Applicant).

The applicant has the right to export and export in customs regime of outward processing the natural diamonds belonging to it on the property right in amount at the time of export and (or) export in customs regime of outward processing no more than 15 percent of cost of the natural diamonds acquired by them in the current year at subjects of production of natural diamonds in the State fund of precious metals and gemstones of the Russian Federation or the state funds of precious metals and gemstones of the subject of the Russian Federation. At the same time the total amount of the natural diamonds exported and exported for conversion cannot exceed the restriction set in this Item for each subject of production of diamonds.

3. For determination of regulations of exit of products of conversion the Applicant of customs regime of conversion of goods on customs area, conversions of goods for internal consumption, conversion of goods out of customs area:

approves with the party determined by the contract for conversion of natural diamonds, the technological production process chart of production of diamonds and specifications (standards) for production of diamonds;

constitutes the forecast of production of the diamonds (on dimensional and weight groups) produced in the course of conversion of natural diamonds according to the assortment specified in the specification which is integral part of the contract;

calculates regulations of exit of products of conversion;

calculates amount of the natural diamonds permitted to export for conversion from the territory of the Russian Federation.

4. Calculation of regulations of exit of products of conversion from the natural diamonds sorted according to the complete nomenclature is made on each line item of natural diamonds which is characterized by certain combination of classification signs.

Calculation of regulations of exit of products of conversion from the natural diamonds sorted according to the enlarged nomenclature is made on each enlarged line item of natural diamonds which is characterized by certain group signs.

5. Regulations of exit of products of conversion of natural diamonds in diamonds are determined in the following procedure:

the regulating documents used when calculating;

description of engineering procedure of production of diamonds;

the list of the used production capacities;

statistical data on processing of natural diamonds similar according to the characteristic and dimensional and weight group which are exported (imported) on conversion natural diamonds;

5.2 forecast calculation of production of the diamonds (on dimensional and weight groups) received in the course of conversion of natural diamonds includes:

5.2.1 determination, based on statistical data of the Applicant, the minimum, maximum and average value of percent of regulation of exit of diamonds on each sowing.
