About application of the Economic Procedure Code of the Republic of Belarus by hearing of cases in Trial Court
For the purpose of ensuring the correct and uniform application by economic courts of the Republic of Belarus regulations of the Economic Procedure Code of the Republic of Belarus in case of permission of economic (economic) disputes and other cases in the Plenum of Supreme Economic Court of the Republic of Belarus Trial Court, being guided by articles 14-16 of the Law of the Republic of Belarus of December 9, 1998 "About economic courts in the Republic of Belarus" (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1999, No. 2, the Art. 32), DECIDES to give to economic courts of the Republic of Belarus (further economic courts) the following explanations.
1. Economic legal proceedings shall be performed in strict accordance with the Constitution of the Republic of Belarus, the Economic Procedure Code of the Republic of Belarus, the laws of the Republic of Belarus, decrees and presidential decrees of the Republic of Belarus, and also international treaties of the Republic of Belarus in the conditions of equality of participants of economic process before the law, recognition behind everyone rights of defense of its rights and legitimate interests competent, independent and just trial, publicity of legal proceedings, competitiveness and equality of participants, and also with respect for other principles of justice.
With respect thereto the refusal in adoption of the action for declaration (statement) on dispute which is subject to consideration in economic court on the bases which are not provided by the Economic Procedure Code of the Republic of Belarus (further - HPK), and also other legal acts, including based on the omission of term of limitation period, inadequate method of protection or form of the address is not allowed.
