This Law establishes the legal basis of state policy of counteraction of organized crime for the purpose of protection of the rights and legitimate interests of the personality, society and the state.

Chapter 1. General provisions

Article 1. The main terms and their determinations applied in this Law

In this Law the following main terms and their determinations are applied:

organized crime – socially dangerous social phenomenon which is expressed in creation of organized groups including gangs, the criminal organizations performing criminal activities, which are characterized by the signs determined by the Criminal code of the Republic of Belarus;

the organization rendering assistance to organized group, the criminal organization – the organization concerning which according to the legislation authentic data on notorious provision of settlement accounts by this organization, production and other rooms, transport and other technical means to the participant (participants) of organized group, the criminal organization for preparation and (or) implementation of criminal activities, and equally in the organization promoting concealment of traces of criminal activities of organized group, the criminal organization are received;

the organization created at the expense of organized group, the criminal organization – the organization concerning which according to the legislation authentic data that its authorized capital is obviously created are received it (is increased) with attraction of financial resources, received as a result of criminal activities of organized group, the criminal organization.
