About personal data protection
The Parliament adopts this organic law.
The purpose of this law is ensuring protection of the rights and personal freedoms when processing its personal data, including protection of the rights to personal privacy, personal and family secret.
(1) This law governs the relations connected with the processing of personal data performed by legal entities and physical persons with use of the automated means or without use of such means if processing of personal data without use of such means corresponds to nature of actions (transactions) made with personal data with use of the automated means.
(2) Operation of this law extends to the relations arising in case of:
a) to processing of personal data by the legal entities or physical persons which are out of the territory of the Republic of Moldova with use in processing of the means which are in the territory of the Republic of Moldova;
b) to processing of personal data in the territory of the Republic of Moldova within the activities performed by the representative on that organization;
c) to the processing of personal data which is carried out within actions according to the prevention and investigation of the crimes or other actions performed within criminal procedure according to the law.
(3) Operation of this law does not extend to the relations arising in case of:
a) to processing of personal data by physical persons only for personal and family needs if at the same time the rights of subjects of personal data are not violated;
b) to processing of the personal data carried in accordance with the established procedure to the data which are the state secret.
