Chapter 1. General provisions

Article 1. Regulation subject

1. This Federal Law governs the relations arising when rendering services by road transport and urban land electric transportation which are part of transport system of the Russian Federation. The relations connected with rendering services by road transport and urban land electric transportation and not settled by this Federal Law are regulated by other Federal Laws and other regulatory legal acts of the Russian Federation.

2. This Federal Law determines general terms of transportations of passengers and baggage, loads respectively by buses, by trams, by trolleybuses, cars, cargo vehicles, including with use of automobile trailers, automobile semitrailer trucks (further also - vehicles), and also general terms of provision of services to passengers, freighters, consignors, consignees, carriers, freighters on objects of transport infrastructures.

3. Transportations of passengers and baggage, loads by road transport in the international message are regulated by international treaties of the Russian Federation.

4. Also regulations of the legislation of the Russian Federation on consumer protection are applied to the relations connected with transportations of passengers and baggage, loads for the personal, family, house or other not connected with implementation of business activity needs.

Article 2. The basic concepts used in this Federal Law

1. For the purposes of this Federal Law the following basic concepts are used:

1) baggage - the passenger's things accepted for transportation in accordance with the established procedure;

2) the ticket - the carriage document certifying the conclusion of the transportation agreement of the passenger;

3) load - the material object accepted for transportation in accordance with the established procedure;

4) the consignor - physical person or legal entity which according to the transportation agreement of load acts on its own behalf or on behalf of the owner of load and is specified in the way bill;

5) the consignee - the physical person or legal entity authorized on receipt of load;

6) the work order - form of the agreement of chartering;

7) container - the equipment having amount at least one cubic meter suitable for reuse and adapted for loading, unloading of load, its overload from one vehicle on other vehicle without intermediate transhipment of cargo;

8) route - vehicle transit between the points of departure and appointments;

9) route of regular transportations - the transit of vehicles intended for implementation of transportations of passengers and baggage according to schedules from starting stopping point through intermediate stopping points to terminal stopping point which are determined in accordance with the established procedure;

10) objects of transport infrastructure - the constructions, production and technological complexes intended for servicing of passengers, freighters, consignors, consignees, carriers and freighters, and also for ensuring work of vehicles;

11) stopping point - the place of stop of vehicles along route of regular transportations equipped for landing, disembarkation of passengers and expectation of vehicles;

12) the passenger - the physical person which signed the transportation agreement of the passenger, or the physical person for the purpose of whose transportation the agreement of chartering of the vehicle is signed;

13) carrier - the legal entity, the individual entrepreneur who assumed obligation according to the transportation agreement of the passenger, the transportation agreement of load to transport the passenger and to deliver baggage, and also to transport the load entrusted by the consignor in destination and to issue baggage, load to person authorized on their obtaining;

14) the route sheet - the document serving for accounting and control of work of the vehicle, the driver;

15) the schedule - the schedule establishing time or intervals of arrival of vehicles of stopping point or departures of vehicles from stopping point;

16) hand luggage - the passenger's things which are transported by the passenger with themselves in the vehicle and which safety is in transit ensured by the passenger;

17) perishable load - load which safety in transit is provided with the vehicle by means of observance of certain temperature condition;

18) the specialized vehicle - the vehicle intended and equipped for transportation of certain types of loads;

19) the terminal - the production and technological complex intended for implementation of the transactions connected with transportation of goods;

20) the way bill - the carriage document confirming the conclusion of the transportation agreement of load;

21) the freighter - physical person or legal entity which shall pay the cost of use of all for the agreement of chartering or part of capacity of one or several vehicles provided on one or several flights for transportations of passengers and baggage, loads;

22) the freighter - the legal entity, the individual entrepreneur who assumed obligation under the agreement of chartering to present to the freighter all or part of capacity of one or several vehicles on one or several flights for transportations of passengers and baggage, loads;

23) information system of electronic carriage documents - the information system providing exchange of the electronic carriage documents and data containing in them between participants of information exchange and also the direction operators of information systems of electronic carriage documents of such documents and data containing in them in the state information system of electronic carriage documents;

24) the state information system of electronic carriage documents - the federal state information system providing:

a) receipt of the electronic carriage documents and data containing in them from operators of information systems of electronic carriage documents, processing, storage of such documents and data containing in them;

b) obtaining, processing, storage and submission of information in case of determination of date and arrival time of the cargo vehicles used for implementation of the international motor transportations belonging to the Russian carriers or foreign carriers to the place of control of arrival of the cargo vehicles used for implementation of the international motor transportations according to the Federal Law of November 8, 2007 No. 257-FZ "About highways and about road activities in the Russian Federation and about modification of separate legal acts of the Russian Federation" (further - reservation of date and time);

c) representation to public authorities of the Russian Federation of the electronic carriage documents and data containing in them;

d) accomplishment of other functions provided by this Federal Law;

25) the agreement on electronic document management of carriage documents - the service provision agreement in the direction of the electronic carriage documents and data containing in them in the state information system of electronic carriage documents. Such agreement is the public agreement and can also provide rendering services in forming of the electronic carriage documents and data containing in them;

26) the accompanying sheet - the carriage document processed or created when giving empty container to the consignor or loaded container to the consignee if loading of load in container, unloading of load from it are performed by means of removal of container from the vehicle;

27) electronic carriage documents - the electronic way bill, the electronic work order, the electronic accompanying sheet, the electronic agreement of chartering, the electronic route sheet, the electronic order and the electronic request, and also other documents based on which it is transported and concerning which are provided by the Federal Laws and other regulatory legal acts of the Russian Federation in the field of transport forming electronically and the direction in the state information system of electronic carriage documents;

28) the electronic way bill - the way bill created in electronic form;

29) the electronic work order - the work order created in electronic form;

30) the electronic accompanying sheet - the accompanying sheet created in electronic form;

31) the operator of information system of electronic carriage documents - the legal entity included in the register of operators of information systems of electronic carriage documents;

32) participants of information exchange - the consignor, carrier, the consignee, the freighter, the freighter, the other person who signed the agreement on electronic document management of carriage documents with the operator of information system of electronic carriage documents;

33) the electronic agreement of chartering - the agreement of chartering created in electronic form;

34) the electronic order - the order of the consignor taken by carrier in case of the conclusion of the transportation agreement of load, created in electronic form;

35) the electronic request - the request of the consignor accepted by carrier in case of the conclusion of the transportation agreement of load, created in electronic form;

36) the electronic route sheet - the route sheet created in electronic form;

37) carrier automobile taxi - the legal entity, the individual entrepreneur or physical person to whom the right to implementation of activities for transportation of passengers and baggage is in accordance with the legislation of the Russian Federation granted to automobile taxi.

2. For the purposes of this Federal Law of the concept "information system", "electronic document" are used in the values determined by the Federal Law of July 27, 2006 No. 149-FZ "About information, information technologies and on information security".

Article 3. Rules of transportations of passengers and baggage, loads

1. The federal executive body performing functions on development of state policy and normative legal regulation in the field of transport approves rules of transportations of passengers and baggage by road transport and urban land electric transportation, and also rules of transportation of goods by road transport.

2. Rules of transportations of passengers and baggage by road transport and urban land electric transportation (further - rules of transportations of passengers) represent the regulatory legal acts regulating procedure for the organization of different types of transportations of passengers and baggage, and also condition of transportations of passengers and baggage and provision of vehicles for such transportations.

3. Rules of transportation of goods by road transport (further - rules of transportation of goods) represent the regulatory legal acts regulating procedure for the organization of transportations of different types of loads, ensuring safety of loads, vehicles, containers and also conditions of transportation of goods and provision of vehicles for such transportations.

Article 3.1. Control (supervision) on road transport, urban land electric transportation and in road economy

1. Control (supervision) on road transport, urban land electric transportation and in road economy behind observance of the mandatory requirements established by the Federal Laws and other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation, municipal regulatory legal acts, international treaties of the Russian Federation, acts constituting the right of the Eurasian Economic Union in the field of road transport and urban land electric transportation, highways, road activities regarding safety of highways, the international motor transportations, cabotage motor transportations is performed by means of:

1) federal state control (supervision) on road transport, urban land electric transportation and in road economy - authorized federal executive body according to the provision approved by the Government of the Russian Federation;

2) regional state control (supervision) on road transport, urban land electric transportation and in road economy - authorized bodies of the executive authority of subjects of the Russian Federation according to the provisions approved by the supreme executive bodies of the government of subjects of the Russian Federation;

3) municipal control on road transport, urban land electric transportation and in road economy - authorized bodies of local self-government according to the provisions approved by representative bodies of municipalities.

2. Subject of federal state control (supervision) on road transport, urban land electric transportation and in road economy is observance:

1) the mandatory requirements established by part 2 Articles 5, Articles 6 and 7, parts 1 and 2 of Article 8, parts 1 and 2 of Article 18, articles 21.1 and 27 of this Federal Law;

2) licensed requirements to activities for transportation of passengers and other persons by buses;

3) mandatory requirements to transportations of dangerous and perishable loads;

4) mandatory requirements to implementation:

a) driving through highways public of federal importance of the vehicles having the permitted maximum weight over 12 tons;

b) movements of heavyweight and large-size vehicles (weight and dimensional control);
