About counteraction of monopolistic activities and development of the competition
This Law determines the organizational and legal basis of the prevention, restriction and suppression of monopolistic activities and unfair competition for the purpose of providing necessary conditions for creation and effective functioning of the goods markets, assistance and development of fair competition, protection of the rights and legitimate interests of consumers.
If other does not follow from contents of this Law, the following basic concepts and their determinations are applied to its purposes:
the goods market - the sphere of the address of the goods which do not have substitutes or interchangeable goods in the territory of the Republic of Belarus or its part determined proceeding from economic possibility of the buyer to acquire goods in the corresponding territory and lack of this opportunity beyond its limits;
business entities - the physical persons and legal entities, other subjects of the civil law which are performing business activity or having the right to perform it;
dominant position in the goods market (dominant position) - the exclusive provision of business entity or several business entities in the market of the goods which do not have substitutes, or interchangeable goods (further - the market of certain goods) giving it (it) the chance to exert decisive impact on general terms of the address of goods in the corresponding goods market or to complicate access to the goods market to other business entities. The provision of business entity is recognized dominating:
1) the share of which in the market of certain goods exceeds the extreme size established by authorized republican state body, except as specified implementation of the state or natural monopoly;
