1. General provisions

1.1. This Provision is developed according to the legislation of the Republic of Tajikistan on subsoil and Regulations on Gosgortekhnadzor of the Republic of Tajikistan and preserving conditions for the most complete extraction useful minerals from subsoil in cases of building of such areas and ensuring protection of objects on building areas from adverse effect of the works connected with use of natural resources is directed to the prevention of unauthorized and unreasonable building of the areas of bedding useful to minerals.

1.2. The procedure for issue permission to buildings of the areas of bedding of minerals, and also to placement in places of their bedding of the underground constructions which are not connected with production useful fossil stopped by this Provision, is obligatory for execution by all ministries, departments, and also legal entities and physical persons, irrespective of patterns of ownership, including foreign states performing designing, construction (reconstruction), expansion of scales of industrial, agricultural and other enterprises (objects), buildings, constructions, communications, including transport, energy agricultural and other purpose, the cities and other settlements, resorts, green plantings (further "construction of facilities") in the territory of the Republic of Tajikistan.

1.3. The permission for construction of the objects rendered in Item

1.2. this provision, it is given to the company - the applicant after obtaining from the relevant geological organization of the conclusion about absence in subsoil under the site of the planned construction of the minerals having industrial value.
