For the purpose of determination of technical requirements and operating conditions of power networks, establishment of the accurate and open relations between different users of power networks, I ORDER:

1. Approve the enclosed Power grid Rules.

2. (Bertisbayev N. B.) to provide to department of power industry and solid fuel in the procedure established by the legislation state registration of these rules.

3. Consider No. 228 which voided the order of the Ministry of Energy and Mineral Resources of the Republic of Kazakhstan of October 1, 2001.

Power grid Rules of the Republic of Kazakhstan

These Power grid Rules determine technical requirements and operating conditions of power network, and also establish the accurate and open relations between her different participants. These Power grid Rules are developed according to requirements of regulations of the Republic of Kazakhstan and international standards.

Section 1. General provisions

Chapter 1. Basic provisions

Paragraph 1. The basic concepts and terms applied in these Power grid Rules (further - ESP)

1. In these rules the following basic concepts are used:

The automated system of commercial accounting - all components and devices established or existing between each point of commercial accounting and the database of commercial accounting. Here the complex of commercial accounting, all related communication lines and the equipment for data processing enter;

Active electric power - average for the period the value of capacity of alternating current characterizing the speed of transformation of electromagnetic energy to other forms (thermal, mechanical, light and so on);

The automatic regulator of capacity (further - automated workplace) - the device of automatic control by output capacity of the generating power station in response to the signals given by the system operator;

The database of accounting - the database consisting of the Register of commercial accounting and data of commercial accounting, serviced and managed by the system operator;

Secondary regulation - slow (over 30 seconds) generation change automatically or manually in normal or after emergency operation;

High voltage (further - VN) - voltage is from 1000 Volts and above;

The generating installation - the device developing the electric power;

The generating installation for start-up of system from completely deenergized condition - the generating installation which can be started and/or work without regular external source of power supply and capable to give food to power supply system after complete de-energization;

Gosstandart - the state body exercising control of works on standardization and certification;

Gosenergonadzor - the Committee on the state energy supervision of the Ministry of Energy and Mineral Resources of the Republic of Kazakhstan performing in compliance and the legislation of the Republic of Kazakhstan functions of supervision and control in the sector of power industry;

The schedule of planned shutdowns - the schedule approved by the relevant parties, containing planned transfer and/or generation and shutdowns of consumers the next calendar year including time of the beginning and the termination, so further;

The schedule of carrying out system testing - the schedule of regular testing of complex of commercial accounting or any equipment or installation, developed by the appropriate responsible subject;

Data of commercial accounting - the data obtained from complex of commercial accounting, and/or the processed data used for carrying out commercial calculations;

The contract for entrance to power networks (further - DVEL) the bilateral agreement between the electric grid company and the user in whom conditions of accession to power networks make a reservation;

Duplicative power lines - the new power lines included parallel to the existing power lines on which transfer of electrical energy and capacity with the normalized quality and degree of reliability, corresponding categorization of subjects of the market is performed;

The contract for provision of support services - the agreement signed between the system operator and the user on provision of support services;

Single electric utility system of the Republic of Kazakhstan (further - EEC of RK) - set of the power plants, power lines and substations providing reliable and high-quality power supply of consumers of the Republic of Kazakhstan;

Start of system after its complete de-energization ("turn from scratch") - process of recovery of operating mode of power supply system after complete or partial refusal in the absence of external source of power supply;

The indicative development plan for production - the plan describing future development of EEC of RK within the next ten years, considering the planned demand, conclusion from operation and production development;

The instruction for prevention and liquidation system the avariyinstruktion which is regularly constituted and updated by the system operator and in which the detailed description of the actions performed by the system operator in case of system accident for providing in short terms of reliable and stable functioning of EEC of RK is given;

Identification code of complex of commercial accounting (IK) unambiguously determined decimal digital code from 18 symbols for each complex of commercial accounting;

Commercial accounting - the accounting of electrical energy necessary for settlement between the parties according to purchase and sale agreements and transfers of electrical energy;

Complex of commercial accounting - the equipment necessary for carrying out commercial accounting located between certain point of commercial accounting and point of connection to the information acquisition device;

Interstate power lines - the power lines providing interstate overflows of capacity and energy;

The local terminal of data collection - the device intended for collection and data storage of commercial accounting on site for check of their correctness or in case of impossibility of remote collection of commercial data;

The minimum generation (further - MG) - the minimum level of the output generated capacity at which the generating installation for maintenance of stable operating mode shall work;

National power grid (further - NES) - set of power lines, substations and distributing devices tension 220, 500, and 1150 kV providing interstate and (or) interregional transfer of electrical energy, issue of capacity of power plants and not privatizeable and to its preliminary stages;

Low voltage (further - NN) - tension is lower than 1000 Volts;

The normal working hours of EEC of RK - the set working hours of EEC of RK in case of which there are in work all elements of power network according to the scheme approved by authorized body and are provided the planned electric utility service of all consumers of electrical energy connected to power network;

The equipment and the equipment - stationary or mobile equipment in which electric conductors or its parts are used;

Integrated Energy System (further - OES) - cumulative infrastructure of the power networks, power plants and other users connected to network;

Restriction on handling capacity of transfer - the restriction of the transferred capacity of electricity transmission determined by the thermal mode of the network equipment, limits by tension and preserving stability of work of power supply system;

Operational reserve - on a centralized basis the approved capacity reserve, available for replacement of primary regulation of frequency and secondary regulation of frequency after accident;

The operator of the market of centralized trade by electrical energy (further - ORTsTE) - the organization performing the centralized biddings by electrical energy including spot biddings of electrical energy;

Certain point of commercial accounting (further - OTKU) physical point on limit of the Section of balance sheet accessory in which the requirements of general accuracy specified in Section 5 of these rules (Commercial accounting) shall be fulfilled. The arrangement of the specified points of commercial accounting shall be approved between the electric grid companies and users of network the relevant agreements;

The wholesale market of electrical energy (further - ORE) - the system of the relations connected with purchase and sale of electrical energy, functioning on the basis of contracts between subjects of the wholesale market of electrical energy;

The organizer of commercial accounting - person or the organization who optionally are subjects of power market, authorized to provide services in commercial accounting, such as provision of complex of commercial accounting, calibration and maintenance of complex to subjects of power market;

The organization of works on safe engineering - the complex of actions providing safe work or testing by personnel on electric equipment of high voltage;

Stop - planned or unplanned conclusion from operation of the power station or the equipment;

The responsible party or the owner of complex of commercial accounting - the physical person or legal entity having complex of commercial accounting on balance, exploiting him and bearing responsibility for it;

Primary regulation - bystry action (within 8-12 seconds) regulators of speed of rotation of turbines of power plants, in case of emergency variations of frequency, performed by means of the generating installations working in the mode of free regulation of the developed capacity;

Transfer of electrical energy - the transportation service of electrical energy rendered by the power transferring organizations according to the signed agreements;

Switching - switching of the equipment and/or equipment according to the instruction THAT or the authorized electric grid company or the user;

The scheduling period - the minimum period of time planned in the daily schedule for which control and management of the mode of production, transfer and consumption of electrical energy and capacity is exercised;

The plan of start of system after its complete de-energization - the Plan for recovery of operating mode of power supply system in case of complete or partial stop which is regularly developed and updated WITH;

The development plan for NES (further - PRNES) - the plan describing all considerable investments into development of power networks in the next five years, including long-term forecasts of loading, location and handling capacity of new lines, equipment conclusion from operation and so on;

The development plan for RES (further - PRRES) - the plan including the long-term forecast of loading in the distribution networks as existing, and planned to construct in the next five years, equipment conclusion of operation, location and handling capacity of new lines and so on;

Planning of actions in emergencies - the Section of Power grid rules in which the rights and obligations of the different parties concerning taking measures to prevention and regulation of large failures in system are specified;

Planned shutdown of generation - Planned removal of the generating installation from work;

Complete de-energization - complete refusal of all or parts of power supply system;

Use of power networks - the arrangement under the terms of which the electric grid companies transferring the electric power give to any subject of the market of electrical energy opportunity of use of their networks;

Use of power networks - the arrangement under the terms of which the electric grid companies transferring and distributing the electric power give to any subject of power market opportunity of use of their networks;

The user of network - the subject of electricity market (legal entity or physical person) using power networks of the electric grid company;

Postemergency operation of work - the set mode arising after emergency shutdown of the damaged element of power supply system (power network) and proceeding before recovery of the scheme of electric utility service provided for normal operating mode;

The consumer - the physical person or legal entity using electrical and (or) heat energy on the basis of the agreement;

Rules on safe engineering - the obligatory rules for the electric grid companies and users ensuring safety of the personnel working at the equipment, falling under action of these rules;

The offer on connection - the official proposal of the electric grid company provided in response to the user's request;

The direct (competent) wholesale consumer - legal entity or physical person with power consumption at least 1 MW of average daily (basic) capacity, having available system of commercial accounting, the telecommunications providing their unification with the systems installed at the System operator, and also the accepting substations (transformer Items) of which, are connected to NES directly or through networks of the third party and acquiring the electric power in the wholesale market of the electric power;

POOL of reserves of capacity of EEC of RK (further - the POOL) - the non-profit organization established on voluntary basis by power plants and certain wholesale consumers for the purpose of forming of necessary amount, structure and placement of reserves of electric power for ensuring regular power supply of consumers in case of unexpected failure of generators or power lines;

Regional power network (further - RES) - set of power lines and substations of 110 kV and below, providing transfer of electrical energy within one administrative and territorial unit (area), and also between NES and consumers;

Reactive electrical energy - energy which is spent for creation of electromagnetic fields in electroinstallations;

The regional electric grid company - the power transferring organization operating power networks of the regional level;

The register of commercial accounting - the register containing information connected with complex of commercial accounting. Information includes type and technical specifications of the equipment, data on check and calibration, the data relating to the specific site and so on;

Substitution reserve (cold reserve) - capacity reserve, available for replacement of short-term failure of the generating installation, or long-term lack of generation which cannot be recovered from initial source;

SCADA - the reduced name for "System of dispatching control and data collection" - the computer system working in real time, used for monitoring and control of power network in real time;

Data collection of commercial accounting - process of search, check and data processing of commercial accounting;

System of safety - the system of measures including process of giving of tension, isolation, grounding and release of the relevant document;

System accident - the emergency violation of working hours of power generation facilities which led to loss of stability of single electric utility system and separation it on part;

System testing - testing of power supply system;

The system operator (further - WITH) - the organization exercising centralized supervisory control, ensuring parallel work with power supply systems of other states, maintenance of balance in power supply system, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy and also transfer of electrical energy on national power grid, its maintenance and maintenance in operational readiness;

Event - any unplanned (or predicted) event in power supply system, including accidents, damages, refusals and so on;

Event of system value - event in power supply system of one party which had or can have serious and/or far-reaching effects for power supply system of other party;

Connection - consolidation of power networks of the electric grid companies and/or users;

The subject of the wholesale market to electric energiienergoproizvodyashchia, the power transferring, power supplying organizations, consumers of electrical energy, the system operator, the operator of centralized trade by electrical energy and other organizations performing activities in the wholesale market of electrical energy;

The party - person or the organization participating in work of electric power industry of the Republic of Kazakhstan;

The counter of commercial accounting - the device intended for measurement and accounting of electrical energy in case of its production, transfer and consumption;

The daily schedule of production consumption electric energiiutverzhdenny the system operator the document regulating hourly sizes of production and consumption of electrical energy for every calendar day according to the agreements on purchase and sale of electrical energy signed by participants of the wholesale market in the markets of the decentralized purchase and sale of electrical energy and centralized trade of electrical energy;

Telecommunication network - the equipment and communication channels providing information transfer between devices in one information system and between information systems;

Technical scheduling - the service rendered by the system operator on implementation of centralized supervisory control of the modes of production and consumption of electrical energy in EEC of Kazakhstan;

Connection point - the approved power supply point established between the electric grid company and the user;

The transformer of own needs of power plant - the transformer providing power supply of the equipment of own needs of power plant;

Corrective action of antiemergency automatic equipment (further - UV of PAS) - automatic impact on the equipment on signal of PAS (shutdown inclusion of the equipment or loading, loading unloading of the equipment and so forth) for the purpose of accomplishment of the tasks assigned to PAS; The data storage Device - the device providing data collection on electrical energy, their picking in five-minute intervals, storage of minimum of data in 50 days and electronic access for WITH through telecommunication network. This device can be separate unit of equipment or is connected to devices of measurement of energy in one physical device;

The data acquisition device (further - USD) - the equipment and the software which is carrying out data collection of commercial accounting;

The actual point of commercial accounting (further - FKTU) - point in which the quantity of electrical energy is measured;

Centralized operational and dispatching upravleniyeosushchestvlyaemy ABOUT process of continuous management technically the coordinated work of the power making, power transferring, power supplying organizations and consumers of electrical energy, the providing normative level of reliability of single electric utility system of the Republic of Kazakhstan and respect for normative quality of electrical energy;

The central dispatching management (further - TsDU) the division entering into structure of the system operator, which is responsible for operational management of EEC of Kazakhstan and reliability of its work including balancing and quality assurance of the electric power;

Operation - the planned activities relating to operation of power supply system;

Power networks - the set of substations, distributing devices and the power lines connecting them intended for transfer of electrical energy;

Power plants - the power station intended for production of electrical energy, containing construction part, the equipment for transformation of energy and the necessary service equipment;

The electric grid company - the legal entity who manages and operates power networks on the right of management or property;

Power grid rules (further - ESP) - these rules;

Power plants for start of system from completely deenergized condition - the power plant having one or several generating installations for start-up of system from completely deenergized condition;

Power plants with self-start - power plants which have opportunity to lift the frequency of rotation of one or several generating installations to the synchronous frequency of rotation and to provide renewal of giving of food in power network in case of lack of power supply of network. Present technical capabilities can be provided with power supply sources for own needs, or according to the agreement signed with external source of power supply;

The power making organization (further - EPO) - the organization performing production of electrical and (or) heat energy.

Paragraph 2. Purpose and tasks of ESP

2. ESP determine technical requirements and operating conditions of power network, establish the relations between her different participants and regulate the following questions:

1) development planning of power networks and EEC of Kazakhstan in general;

2) conditions of access to power networks;

3) management of work of EEC of Kazakhstan;

4) organization of commercial accounting of the electric power;

5) services of regional power network;

6) creation of schedules and assessment of reliability of work of EEC of Kazakhstan;

7) rendering services in technical scheduling.

3. ESP govern the relations between different users of power networks. At the same time they do not contain the provisions regulating internal activities of the electric grid companies.

4. The main subjects of execution of these ESP are:

1) technical operator of EEC of Kazakhstan;

2) electric grid companies;

3) market operator;

4) the power making organizations;

5) consumers of electrical energy;

6) the power supplying organizations;

7) trade and intermediary companies.

Paragraph 3. Contingencies

5. In case of the contingencies unaccounted in these ESP, SO and the electric grid companies respectively (the questions connected with power lines of interregional level belong to WITH; the questions connected with distribution power lines belong to REK), depending on case, shall consult without delay with all involved parties for reaching an agreement on possible actions or take measures according to the current legislation of the Republic of Kazakhstan.

If the agreement between WITH or the electric grid company and other parties was not reached, WITH or the electric grid company, shall determine necessary measures for elimination of the arisen contingencies and notify the parties and authorized body on the decision and arguments for benefit of its acceptance.

In all cases when WITH or the electric grid company make such decision, it shall consider as much as possible opinion of the parties on this matter.

6. In case of execution of the decision each party shall follow all instructions WITH or the electric grid company which shall not break reliable operation of power stations of certain party. WITH or the electric grid company shall inform without delay on all cases of contingencies and the made decisions.

Paragraph 4. Matters of argument

7. The disputes arising in the course of application of these rules are solved according to the current legislation of the Republic of Kazakhstan.

Paragraph 5. Sector of power industry of Kazakhstan

8. The power industry of the Republic of Kazakhstan consists of the power making organizations (EPO) of different function, the electric grid companies, the power supplying organizations, wholesale consumers of electricity, the System Operator (SO) and the Operator of the market of centralized trade by electrical energy (ORTsTE), the authorized body performing functions of public administration by power industry.

9. State regulation in the field of power industry consists in:

1) licensing;

2) state regulation of rates (prices, rates of charge);

3) demonopolizations and privatizations of power generation facilities;

4) state supervision of reliability, safety and profitability of production, transfer, technical scheduling and consumption of electrical energy;

5) development and approval of regulatory legal acts of the Republic of Kazakhstan, the regulating technical documents containing technical and production requirements of regulation of activities and the relations in the field of production, transfer, technical scheduling and consumption of electrical and heat energy and also the regulations providing reliability, profitability and safety of construction and operation of lines of zlektroperedacha, electro-and power stations.

10. The market relations in power industry are performed according to regulatory legal acts of the Republic of Kazakhstan.

The electricity market consists of the following parallel and complementary markets:

1) the market of the decentralized purchase and sale of electrical energy functioning on the basis of the purchase and sale agreements of electrical energy signed by participants of the market at the prices and delivery conditions established by the agreement of the parties;

2) the market of centralized trade of electrical energy representing organized trading floor for purchase and sale of electrical energy on short-term (spot biddings), medium-term (week, month) and long-term (quarter, year) the basis;

3) the balancing market in real time functioning for the purpose of physical and subsequent financial settlement of the hourly imbalances arising in operational days between the actual and contractual sizes of production consumption of electrical energy in single electric utility system of the Republic of Kazakhstan approved WITH in the daily schedule of production consumption of electrical energy;

4) the market of system and support services functioning on basis as acquisitions at subjects of the wholesale market of electrical energy, and rendering FROM the corresponding services to subjects of the wholesale market of electrical energy for providing with the established state standards of reliability of work of single electric utility system of the Republic of Kazakhstan and quality of electrical energy.

11. ORTsTE performs functions:

1) the spot biddings performs the organization and carrying out;

2) performs the organization and carrying out centralized trade of electrical energy on medium-term (week, month) and long-term (quarter, year) the periods;

3) provides equal conditions of access for subjects of the wholesale market of electrical energy to the market of centralized trade of electrical energy;

4) is determined by compliance of subjects of the wholesale market of electrical energy to the requirements established by rules of centralized trade of electrical energy;

5) performs registration and accounting of the concluded bargains on purchase and sale of electrical energy at the centralized biddings of electrical energy;

6) provides within the competence subjects of the wholesale market of electrical energy with information on the indication prices of electrical energy which developed at the centralized biddings and other market information.

12. SO UES of RK performs the following functions:

1) renders system services in transfer of electrical energy in national power grid according to the agreement, provides its maintenance and maintenance in operational readiness;

2) renders system services in technical scheduling, exercising centralized supervisory control of working hours of single electric utility system of the Republic of Kazakhstan according to the agreement, including creation of the actual balances and forming of the daily schedule of production consumption of electrical energy;

3) is provided by reliability of work of single electric utility system of the Republic of Kazakhstan;

4) renders system services in regulation of electric power;

5) renders system services in physical settlement of imbalances of electrical energy;

6) is performed by the subsequent financial settlement of imbalances of electrical energy according to the procedure, established by the legislation of the Republic of Kazakhstan;

7) also involvement of reserves of capacity in single electric utility system of the Republic of Kazakhstan determines amount, structure, distribution of reserves of capacity between the power making organizations;

8) performs the organization of functioning of the balancing market of electrical energy in real time and the market of system and support services;

9) interacts with power supply systems of the adjacent states on management and ensuring stability of the modes of parallel work;

10) performs technical and methodical guidance on creation of unified information system, the automated system of commercial accounting of electrical energy, the integrated devices of relay protection and antiemergency automatic equipment of all subjects of the wholesale market of electrical energy;

11) provides equal conditions for access for subjects of the wholesale market of electrical energy to national power grid;

12) provides participants of the wholesale market of electrical energy of the Republic of Kazakhstan with information which is not mentioning the data which are the commercial and protected by the law other secret;

13) is approved by conclusion in repair of the capital equipment of power plants, substations, power lines, devices of relay protection and antiemergency automatic equipment, systems of technological management and ensuring their availability for service;

14) participates in development of working hours of hydroelectric power stations taking into account their hydroeconomic balances and working hours of single electric utility system of the Republic of Kazakhstan;

15) performs development of long-term forecasting of balances of electrical energy.

12-1. Centralized supervisory control of single electric utility system of the Republic of Kazakhstan consists:

1) in the management of the modes of production, transfer and consumption of electrical energy in single electric utility system of the Republic of Kazakhstan realizing conditions of purchase and sale agreements, transfers of electrical energy, regulation of electric power, balancing of production consumption of electrical energy;

2) in management of the modes of interstate overflows of electrical energy;

3) in ensuring prevention, localization and liquidation of technological violations in single electric utility system of the Republic of Kazakhstan;

4) in operational management by capacity reserves in single electric utility system of the Republic of Kazakhstan;

5) in determination of structure, the principles, locations, amounts and settings of systems of relay protection, antiemergency and regime automatic equipment ensuring reliable and steady functioning of single electric utility system of the Republic of Kazakhstan;

6) in forming and approval of daily schedules of production consumption of electrical energy in single electric utility system of the Republic of Kazakhstan;

7) in creation of the actual balances of production consumption of electrical energy in the wholesale market of electrical energy.

13. The power making organizations (EPO) are divided into power plants:

1) national value;

2) industrial function;

3) integrated with the territories and power plants of the heatsupplying companies.

The condensation power plants of big capacity and hydroelectric power station used for regulation of the load graph of EEC of Kazakhstan treat power plants of national value.

The power plants belonging to industrial complexes treat power plants of industrial function.

The power plants integrated with the territories are the power plants connected to networks of the regional electric grid companies which energy is implemented mainly in the retail market.

14. The Distribution Electric Grid Companies (DEGC) make transfer of electrical energy in certain regions of Kazakhstan and are connected directly to substations of the National power transferring organization (SO). REK supply with electrical energy the population, industrial consumers, agricultural industry and other consumers.

15. The construction organizations and specialized repair shops render services in construction, installation and adjustment of objects of power and separate installations, and also services in specialized repair for subjects of the electrical power market.

16. In industry also specialized research and design and survey institutes are effective. They are called to solve problems of implementation of new effective energy-saving and environmentally friendly technologies for production and power supply of consumers.

Paragraph 6. The market relations in power industry

17. Main objectives of introduction and enhancement of the market relations in power industry of Kazakhstan are:

1) liberalization of the economic relations in the field of power industry;

2) ensuring open and equal entry to the market of electrical energy of sellers and buyers of electrical energy;

3) forming of competitive environment between sellers of electrical energy. Increase in payment discipline;

4) increase in reliability of functioning of EEC of Kazakhstan on the basis of the cross liability of subjects of the market, creation of optimum operating modes of power network, creation of reserves of capacity for prevention of breaks in electric power consumption in case of unexpected power deceleration by any generation company or inadvertent outage of any site of NES.

18. The market relations in power industry are performed according to the regulatory legal acts of the Republic of Kazakhstan operating during each specific period of time and expressed by the following main market transactions:

1) purchase and sale of active electrical energy according to terminal (forward) bilateral agreements of sellers with buyers on contract prices;

2) centralized purchase and sale of active electrical energy on the open competitive tenderings by cash capacity in the modes "in day ahead" and "for the hour ahead" performed by the Market operator;

3) centralized purchase and sale of reserves of active electric power for the purpose of prevention of accidental violations of balance of electrical energy at rate of real time;

4) centralized trade by reserves of active capacity and the electric power for maintenance of continuous electric utility service of consumers with normative electric power quality in situations of emergency shutdown of capacities;

5) centralized trade by the regulating capacity for the purpose of regulation of daily schedules of production of electric power of the separate power making organizations and consumption maps of capacity of certain consumers;

6) sale of services of the Technical operator of the following types:

management of transfer of electric power on the organization of parallel work of subjects of the market of EEC of Kazakhstan,

technical scheduling of leave in network of the electric power of all power making organizations and the imported electric power on the exclusive rates established by regulating authority;

7) provision Market and Technical operators of support and additional services (purchase and sale of reactive capacity for the purpose of quality assurance of tension in power nodes of EEC of Kazakhstan, sale of handling capacity of NES, etc.).

19. Subjects of the market relations in power industry are:

1) sellers of electric power and energy - the power making organizations (EPO):

power plants;

the legal entities owning industrial complexes as a part of which there are power plants having excesses of electric power and the electric power for sale on electricity market;

power supply systems of the adjacent states.
