About approval of Industrial safety rules for employees of sea fish ports

According to the Law of Ukraine "About labor protection", the Regulations on the State committee of Ukraine on industrial safety, labor protection and mountain supervision approved by the resolution of the Cabinet of Ministers of Ukraine of 23.11.2006 of N 1640, I ORDER:

1. Approve Industrial safety rules for employees of sea fish ports (further - Rules) which are applied.

2. Enact the order since 01.04.2007.

3. With entry into force of the order to consider such which are not applied in the territory of Ukraine Governed on safe engineering in fish ports, the Central Committees of labor union of workers of the food industry approved by Presidium, the protocol of 25.12.68 of N17.

4. (Tkachov V. S.) in five-day time to provide to department of the organization of the state supervision in the AIC and the welfare sphere provision of this order on state registration in the Ministry of Justice of Ukraine.

5. To management of normative and legal and legal providing (Kalinovskaya I. G.) enter Rules in the State register of regulatory legal acts on labor protection and place them on the web page of Gosgorpromnadzor.

6. To chiefs of territorial administrations of Gosgorpromnadzor to take measures for studying of requirements of Rules by the state inspectors and to provide systematic control of observance of requirements of Rules.

7. To the editor-in-chief of the Labor protection magazine Yakovenko M. G. to publish the order in the future issue of the magazine.

8. To impose control over the implementation of this order on the vice-chairman of Gosgorpromnadzor Dolmatov O. I.

Industrial safety rules for employees of sea fish ports

1 General provisions

1.1 These Rules extend to sea fish ports, assigned portpunkta, and also to all subjects of fishing activities, irrespective of legal form and pattern of ownership in which operation there are moorings and piers which are used for any cargo operations, including for providing courts with material delivery and food.

1.2 For overload and storage of loads, and also accomplishment of other transactions the port shall be equipped:

weight handling equipment for carrying out cargo operations as near the coast, and afloat;

store buildings, canopies, platforms and in reservoirs warehouses for breakbulk cargoes, refrigerator warehouses (refrigerators), warehouses of dry bulk cargoes, liquid cargoes and so forth;

office and household buildings;

utility power systems for power supply of dockside electric equipment and lighting during work in port with nightfall or during insufficient visibility, systems of automation of production processes, the fire alarm and communication;

systems of heat supply, water supply and sewerage;

devices and equipment for protection of the circle against pollution;

port and office and auxiliary fleet;

construction and repair divisions and equipment for repair of port installations and devices.

1.3 During execution of the works which are not specific to fish ports it is necessary to be guided by the corresponding regulations on labor protection.

1.4 According to article 15 of the Law of Ukraine "About labor protection" (with changes) and requirements of the Standard regulations on security service of work, the approved order of the State committee of Ukraine on supervision of labor protection of 15.11.2004 N 255, registered in the Ministry of Justice of Ukraine 01.12.2004 on N1526/10125 (NPAOT 0.00-4.21-04), in sea fish ports is created security service of work.

The security service of work of port submits directly to the employer.

1.5 According to article 5 of the Law of Ukraine "About labor protection" during execution of an employment agreement the employer shall inform the worker on receipt on working conditions and on availability on its workplace of dangerous and harmful production factors which are not eliminated yet, about possible effects of their impact on health and about the worker's rights to privileges and compensations for work in such conditions according to the legislation and the collective agreement.

Work which according to medical certificates is contraindicated to him for health reasons cannot be offered the worker.

1.6 In sea fish ports instructions for labor protection according to the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of 29.01.98 of N 9, registered in the Ministry of Justice of Ukraine 07.04.98 for N226/2666 shall be developed (NPAOT 0.00-4.15-98).

1.7 Employees of sea fish ports at works with harmful and dangerous working conditions, and also works which are connected with pollution or performed in adverse temperature conditions shall be provided with the special clothes, special footwear and other individual protection equipment according to Regulations of free issue of special clothes, special footwear and other individual protection equipment to employees of fishery approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash of 11.04.2006 of N 214, registered in the Ministry of Justice of Ukraine 21.04.2006 on N473/12347 (NPAOT 05.0-3.03-06).

1.8 Investigation and accounting of accidents, occupational diseases and accidents on production shall be performed according to the Procedure for investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of 25.08.2004 of N1112 (with changes).

2 Determination of terms

In these Rules the terms below are used in the following value:

the water area - the site of surface of the water in certain borders;

rail-post - lath which serves as step of shtormtrap;

beams hatch - removable beams which serve as support of removable covers of hatches;

the internal ship courses - the ship courses which connect separate harbor areas;

crew of the vessel - staff of the vessel which provides management, movement, survivability and safety of operation of the vessel;

external raid - part of the water area which is behind borders of protective constructions;

kabolka - the thread twisted from yarn fibers;

bollards - the curbstones attached to the deck of the vessel and intended for fixture of mooring rope;

collective rescue means - the means capable to provide preserving life of people who are in distress, from the moment of leaving of the vessel by them;

the fender - the device (the wooden, rubber, pneumatic or sewed from canvas sack filled by pile and braided with kabolka) which serves for mitigation of blows during approach (withdrawal) of the vessel;

tench - wattled cable with a diameter up to 25 mm;

lyuchina - strong wooden removable boards which serve for closing of hatches;

sea both inland waterways - natural and artificial water spaces and waterways which are used for the purpose of navigation implementation;

the notification - the message on readiness of the vessel for cargo operations;

agones - loop on the end of cable;

пайол - flooring in hold of the vessel or in machine and boiler department;

the approach channel - the external ship course;

port GTS (further - GTS) - hydraulic engineering constructions which are used for ensuring transportation of goods and passengers, creation, repair and servicing of courts;

The shipping register of Ukraine - national classification society which exercises technical supervision and carries out classification of ocean and river merchant vessels. Belongs to the sphere of management of the Ministry of transport of Ukraine;

the fishery fleet - vessels of the fleet which take part in production, processing, acceptance and transportation of fish and other water live resources;

the office and auxiliary fleet of fishery - court of the fleet which directly do not take participation in production, processing, acceptance and transportation of fish and other water live resources during trade;

the twin deck - interdeck space in internal part of the case of the vessel;

notches - deepening in wooden vessel, loads and so forth;

hrapts - hoisting slings for raising of barrels;

mooring - the vegetable or steel cable brought to time of mooring of the vessel;

shkentel - the steel end of soft cable with ogony on the end;

шкерт - the thin short end of cable;

шлаг - cable turnover around the bollard or turachka.

3 List of dangerous and harmful production factors

3.1 During execution of works the following dangerous and harmful production factors which impact on the worker under certain conditions can cause occupational disease, temporary or permanent decrease in working capacity can act on coastal part, the water area and courts on employees of sea fish ports, increase the frequency of somatic and infectious diseases:

3.1.1 Physical:

machines and mechanisms which move;

mobile parts of production equipment;

the increased danger of reloading works;

skolzkost of floor, ship deck and workplaces;

rolling of the vessel during execution of ship works;

break of the ropes tense under loading, cables and chains;

probability of fall from height, in hold and overboard courts;

big depths of water and possibility of drowning of people;

the increased dust content of air of the working area;

pozharo-and potential of explosion of fuel and other applied oil products;

the increased or reduced humidity of air;

the increased or reduced air temperature of the working area, the surface of the equipment, pipelines;

adverse hydroweather conditions - fog, thunder-storm, heavy rain, storm and so forth;

the increased noise level and vibrations on workplaces;

the raised or reduced personal property of air;

excessive speed of increase of pressure, the partial pressure of oxygen is increased, the partial pressure of nitrogen, the increased concentration of carbon dioxide, hydrocarbons, oxides of carbon and oxide of nitrogen during execution of diving works is increased;

the increased level of solar radiation;

the increased tension in power network which short circuit can pass through body of the person;

electromagnetic radiation;

absence or insufficiency of natural lighting;

insufficient illumination of the working area.

3.1.2 Chemical:

the raised gas contamination of air of the working area;

toxicity, harm and irritant action washing, disinfectants and other dangerous liquids and substances;

on nature of impact on human body - toxic, irritating, sensibilyativny;

on the way of penetration into human body - through respiratory organs, integuments and mucous membranes.

3.1.3 Biological:

pathogenic microorganisms and products of their life activity.

3.1.4 Psychophysiological:

physical overworks (static and dynamic);

psychological overloads (work at height, monotony of work, emotional overloads and so forth).

4 Requirements to personnel which take part in production processes

4.1 Employees of sea fish ports, including members of crews of vessel and watercrafts of the port and office and auxiliary fleet, shall know and fulfill requirements of the existing regulatory legal acts concerning labor protection, safety of navigation, rules of the handling of machines, mechanisms, vehicles, the equipment and other means of production; be able to use means of individual and collective protection, individual and collective rescue means, and also means of suppression of the fires; be able to provide first aid to the victim in case of industrial injuries, cuts, burns, poisonings and so forth; be observed the obligations on labor protection provided by the collective agreement and employment policies and procedures.

4.2 During employment and in the course of work workers shall undergo in sea fish ports at the expense of the employer training, instructing and examination concerning labor protection according to the Standard regulations on procedure for carrying out training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of 26.01.2005 of N 15, registered in the Ministry of Justice of Ukraine 15.02.2005 for N231/10511 (NPAOT 0.00-4.12-05).

4.3 During employment of minors and women it is necessary to follow regulatory legal acts, in particular the List of hard work and works with harmful and dangerous working conditions on which application of the work of minors approved by the order of the Ministry of Health of Ukraine of 31.03.94 of N 46, registered in the Ministry of Justice of Ukraine 28.07.94 for N176/385, of the List of hard work and works with harmful and dangerous working conditions on which application of the work of women approved by the order of the Ministry of Health of Ukraine of 29.12.93 of N 256, registered in the Ministry of Justice of Ukraine 30.03.94 for N51/260, of Limit requirements of rates of lifting and movement of the heavy things by minors approved by the order of the Ministry of Health of Ukraine of 22.03.96 of N 59, registered in the Ministry of Justice of Ukraine 16.04.96 for N183/1208, and Limit rates of lifting and movement of heavy things by women is forbidden is forbidden, N 241, approved by the order of the Ministry of Health of Ukraine of 10.12.93 registered in the Ministry of Justice of Ukraine 22.12.93 for N194.

4.4 Officials of the site (service) shall take measures for elimination of all abuses of regulations of labor protection found prior to the beginning of or during execution of works. If elimination of violations is impossible and they threaten life and human health, works shall be stopped, and people are removed to the safe place.

5 Sanitary and hygienic requirements

5.1 The territory, the water area, constructions, buildings, rooms, engineering procedures, the equipment in sea fish ports shall meet the requirements:

The health regulations of production process and hygienic requirements to production equipment approved by the order of the Ministry of Health of the USSR, 1973 N1042, Approximate Safe Levels of Impact (ASLI) of hazardous substances in air of the working area, approved by the order of the Ministry of Health of Ukraine, 1993 N5203, Hygienic classifications of work approved by the order of the Ministry of Health of the USSR, 1986 N4137, Health regulations and regulations of protection of coastal waters of the seas from pollution in the places of water use of the population approved by the chief state health officer of the USSR 06.07. 88, the State sanitary standards and rules in case of performance of works in not switched off electroinstallations up to 750 kV inclusive approved by the resolution of the chief state health officer of Ukraine of 09.07.97 of N198 (GSN 198-97), the State sanitary standards of production noise, ultrasound and infrasound approved by the resolution of the chief state health officer of Ukraine of 01.12.99 of N37 (GSN 3.3.6.037-99), the State sanitary standards of production general and local vibration approved by the resolution of the chief state health officer of Ukraine of 01.12.99 of N39 (GSN 3.3.6.039-99).

5.2 Temperature, relative humidity, speed of movement of air in the working area of production rooms shall meet the requirements of Sanitary standards of microclimate of the production rooms approved by the resolution of the chief health officer of Ukraine of 01.12.99 of N42 (GSN 3.3.6.042-99) but GOST 12.1.005-88 "SSBT. General sanitary and hygienic requirements to air of the working area", the State committee of the USSR on standards approved and enacted by the resolution of 29.09.88 N3388.

5.3 The water area of port shall keep in proper sanitary position. In borders of the water area it is not allowed to throw out in water and on ice slag, garbage, food wastes, container, waste paper and any other objects, and also to extort oil, oil and water with impurity of oil, oil and fatty waste.

5.4 In sea fish ports there shall be auxiliary and household rooms according to requirements Construction Norms and Regulations 2.09.04-87 "Office and household buildings", N313 approved by the resolution of the State construction committee of the USSR of 30.12.87 (with changes and amendments). Safety requirements to buildings, constructions and rooms, and also requirements to sanitary household providing crew personnel and employees of port are provided in Sections 8 and 24 of these Rules.

5.5 During employment and throughout work workers shall be subject to medical examinations. Requirements to medical examinations are provided in Section 25 of these Rules.

5.6 In all production, household and auxiliary rooms it is necessary to maintain purity.

6 Safety requirements to the port water area

6.1 Basic elements of the port water area is:

approach channel or external ship course;

external raid which is behind borders of protective constructions;

entrance raid - part of the internal water area which adjoins to gate of port;

the operational water area on which the parking of courts and auxiliary watercrafts under reloading works and maneuvers is performed during approach and withdrawal of courts about moorings;

the internal ship courses which connect certain areas;

internal raids of different function.

6.2 For ensuring convenience of entrance and exit, turn and maneuvering of courts in case of their approach to moorings, the safe and convenient parking about moorings during reloading, bunkering and other transactions the port shall have the water area of the sufficient sizes and the forms.

6.3 The water area shall be, in process of forces, is protected from wind, and also due to construction of external and internal raid protective constructions and rational configuration of port is protected from waves.

6.4 On the water area of port places for sediment of the port and office and auxiliary fleet shall be provided.

6.5 External raid shall be used for sediment of courts, reloading transactions afloat, bunkering of courts, supply of fresh water, food and so forth.

6.6 Internal raid and port pools shall have natural or artificial protection against disorders, currents, adjournment of deposit and other factors which complicate accomplishment of pogruzo-unloading works or maneuvering of courts on the port water area for what sea protective constructions - breakwaters and pier shall be constructed.

6.7 Water areas of ports, ship canals and coastal areas of the sea shall have normative depths of water and to be equipped with navigation equipment according to requirements of existing rules and rules.

6.8 For support of depths of the water area and channels it is necessary to carry out dredging through the relevant courts of the technical fleet.

6.9 Violation of depths, especially near berthing, protective and other port hydraulic engineering constructions is not allowed that can entail to washout of soil of the bases of constructions water streams which are formed under the influence of screws of courts.

6.10 On the approach channel and the water area the traffic safety of vessels shall be ensured.
