About some measures for protection of the rights of the citizens performing work on civil and employment contracts

For the purpose of ensuring timely settling with citizens for the performed work, the rendered service and the created intellectual property item in civil agreements and protection of their separate social and labor rights:

1. Determine that:

1.1. the legal entities and individual entrepreneurs employing citizens under civil agreements which subject is performance of works, rendering services and creation of intellectual property items (further - civil agreements) shall sign the specified agreements with them in writing and determine in these agreements except the conditions established by the legislation, the following essential conditions:

procedure of payments of the parties under civil agreements, including the amounts which are subject to payment;

the obligation of the customer - the legal entity or the individual entrepreneur employing citizens under civil agreements (further - the customer), on payment for them in accordance with the established procedure compulsory insurance premiums for the national social insurance in the budget of state non-budgetary fund of social protection of the population of the Republic of Belarus;

obligations of the parties on providing safe working conditions proceeding from the obligations of the Parties of the civil agreement listed in subitems 1.3 and 1.4 of this Item and responsibility for their failure to carry out;

bases of early termination of the civil agreement;

responsibility for non-execution by the customer of obligations on payment of the performed work, the rendered service or the created intellectual property item in the form of penalty in the amount of at least 0,15 of percent of outstanding amount for each day of delay;

the obligation of the customer on payment of insurance premiums on compulsory insurance from labor accidents and occupational diseases if performance of works, rendering services, creation of intellectual property items under the civil contracts with citizens signed by it is performed in the places provided by the customer;
