1. This Procedure is developed based on article 13 of the Law of the Republic of Tajikistan "About the competition and restriction of monopolistic activities in the goods markets" and establishes rules of forming and maintaining the Register of the business entities holding dominant position in the goods market (further the Register), the state regulation created for the purpose of implementation and control on observance of the antitrust law by them.

2. Forming and maintaining the Register performs the authorized body performing the antimonopoly policy (further - authorized body).

3. Inclusion in the Register and exception of it of business entities (irrespective of the place of their registration) are performed based on the decision of authorized body if the business entity has the share established by the antitrust law in the corresponding goods market of the Republic of Tajikistan in general.

4. When forming the Register by authorized body the following information confirming availability or absence at business entity of share in the market of the certain goods established by the antitrust law of the Republic of Tajikistan is used:

- analysis results and estimates of condition of competitive environment in the goods market carried out by authorized body (its territorial authority);
