About mental health services and guarantees of the rights of citizens in case of its rendering

This Law determines the legal basis of state regulation of rendering mental health services, guarantees and rights of citizens in case of its rendering and procedure for protection of their rights.

Chapter 1. General provisions

Article 1. Basic concepts and their determinations

In this Law the following basic concepts and their determinations are applied:

the psychiatrist - the specialist who by the legislation of the Republic of Belarus is granted the right to be engaged in psychiatric practice;

hospitalization - the placement of the citizen to mental health (psychoneurological) facility;

emergency mental health services - the mental health services given to the citizen according to the decision of the psychiatrist (the commission of psychiatrists) in cases when the delay in its rendering can do harm to life and health of this citizen or to lead to actions, life-threatening and to health of the citizen or life and health of other citizens;

the patient - the citizen suffering from mental disturbance (disease) or the citizen who is given mental health services;

the representative - person authorized according to the legislation of the Republic of Belarus to represent the interests of the patient and (or) to perform certain rights from his name;

mental health services - type of the specialized medical care including inspection of mental condition, diagnostics of mental disturbances (diseases), treatment and prevention of aggravations of mental disturbances (diseases), medico-social adaptation and rehabilitation of citizens;
