    According to Regulations on Committee on supervision of the safe operation in the industry and nuclear power under the Ministry of Emergency Situations of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of June 10, 1997 No. 675 (Collection of decrees, presidential decrees and orders of the Government of the Republic of Belarus, 1997, No. 19, Art. 662; The National register of legal acts of the Republic of Belarus, 1999, No. 8, 5/86), and for the purpose of reduction of regulating documents in compliance with the Code of the Republic of Belarus about subsoil the Committee on supervision of safe operation in the industry and nuclear power under the Ministry of Emergency Situations of the Republic of Belarus decides:

1. Approve the enclosed Single rules of protection of subsoil in case of development of fields of solid minerals.

2. With enforcement of Single rules of protection of subsoil in case of development of fields of solid minerals action of Single rules of protection of subsoil in case of development of fields of the solid minerals approved by the resolution of Gosgortekhnadzor of the USSR of May 14, 1985 No. 22, in the territory of the Republic of Belarus stops.

Single rules of protection of subsoil in case of development of fields of solid minerals

Chapter 1. General provisions

1. Single rules of protection of subsoil in case of development of fields of solid minerals (further - Rules) are developed on the basis of the legislation of the Republic of Belarus on subsoil, and also acting in the field of subsurface use of normative and technical documents. Rules establish requirements for rational, complex use and protection of subsoil and the environment in case of development of fields of solid minerals (further - fields).

Rules are obligatory for all legal and physical litspolzovatel of subsoil irrespective of patterns of ownership and production stage of the works connected with use of subsoil in the territory of the Republic of Belarus.

In Rules the terminology accepted in the Code of the Republic of Belarus about subsoil is used (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1998, No. 8-9, of Art. 103; it is registered in the National register of legal acts of the Republic of Belarus 20.03.2001 No. 2/642) and other normative and technical documents regulating conditions and procedure for development of fields.

With entry into force of these rules it is terminated in the territory the Republic of Belarus Single rules of protection of subsoil in case of development of fields of the solid minerals approved by the resolution of Gosgortekhnadzor of the USSR of May 14, 1985 No. 22.

2. Development of fields is allowed on condition of observance of the Code of the Republic of Belarus about subsoil and in the presence at the subsoil user:

licenses for mining;

the geological report with stock counting of minerals and the protocol of the Republican commission on inventories of minerals (further - RKZ) or on condition till April 1, 1999, the State Commission on Mineral Reserves (further - GKZ), the territorial commission on inventories of minerals (further - TKZ), the central (industry) commission on inventories of minerals (further - TsKZ), scientific and technical council of the organization or the company (further - NTS) about their approval;

the delivery-acceptance certificate of the field in industrial development;

the design estimates approved in accordance with the established procedure on construction of the company for mining (further - the mountain company);

the license (act) for mineral right for production of mineral and materials of mountain branch, the certificate of registration of mountain branch;

the state act on right to use by the earth and materials of land branch;

licenses for the special types of activity connected with the increased danger when using natural resources;

the annual plan of the development of mining operations including standard rates of the losses approved with Department on supervision of safe operation in the industry of the Ministry of Emergency Situations of the Republic of Belarus (further - the Gospromnadzor) and approved in accordance with the established procedure;

geological (including reports on the carried-out investigation and additional exploration of the field), the geodetic, surveying and other timely filled up documentation (including gornografichesky);

reports of the specialized organizations for results of the carried-out technological testing of minerals, the hydrogeological, engineering-geological researches, studying of the gas mode of fields and other mining parameters and conditions of their development which was carried out in case of investigation and additional exploration of the field;

reference collection of samples or core of exploratory wells and duplicates of tests of minerals and breeds in the amounts necessary for further geological studying of the field in case of its development, special industry instructions on technology of works in case of mining by nonconventional methods.

Availability at the subsoil user of the license for mining grants the carrying out right in accordance with the established procedure within the mountain withdrawal of additional exploration and operational investigation provided to it.

3. Provision of the license for mining is performed according to the regulating documents approved in accordance with the established procedure.

Withdrawal of the parcel of land in final borders for construction of the company and mining of minerals is performed according to the procedure, established by the land legislation of the Republic of Belarus, after approval of the project on construction of the company and receipt of mountain branch.

4. Provision of mountain branch to the subsoil user is made according to Regulations on procedure for provision of subsoil plots (mountain branches) for mining, construction and (or) operation of the underground constructions which are not connected with mining, the approved resolution of Council of Ministers of the Republic of Belarus of March 24, 1999 No. 412 (The national register of legal acts of the Republic of Belarus, 1999, No. 29, 5/509).

Precedes receipt of mountain branch on mining creation of the project of reasons for its borders according to the Instruction for creation of the project of reasons for borders of mountain branch and forms of acts of provision of mountain branch and the book of accounting (register) of their issue approved by the order of Committee on supervision of safe operation in the industry and nuclear power under the Ministry of Emergency Situations of the Republic of Belarus of May 13, 1999 No. 58 (The national register of legal acts of the Republic of Belarus, 1999, No. 65, 8/489).

The decision on provision of mountain branch is made by local council of deputies with issue to the subsoil user of the relevant act.

After receipt of the license (act) for mineral right the subsoil user shall register it in Gospromnadzor.

5. Mountain branch for production of mineral is provided, as a rule, for development of all field or its part. On development of the large-scale deposit, usually vulgar bedding, mountain branches can be provided to two or several subsoil users with assignment of the coordinating functions on one of them by the Gospromnadzor or the Ministry of Natural Resources and Environmental Protection of the Republic of Belarus (further - Ministry for Protection of the Environment and Natural Resources) in case of production of peat and sapropels.

6. In need of development of fields of different types of the minerals lying on one square, mountain branches are provided separately for development of each field. In this case, and also in case of development of the large-scale deposit by several mountain companies the sequence of working off of fields or their parts and agreement of mining operations provided by their projects shall provide rational, most complete use of all explored reserves of minerals, and also fulfillment of requirements on safety of mining operations, protection of subsoil and the environment.

It is forbidden to leave outside mountain branch the sites of the field unsuitable on technical or economic purposes for independent development.

Development of sites of the field is forbidden if they are outside originally provided mountain branch.

If the border of the provided mountain branch on any site spatially is coordinated to geological structure (the line of wedging out of layer, tectonic violation) which provision in subsoil is definitely not established, then this border without fail is subject to refining in the course of carrying out underground mountain and preparatory and prospecting developments that behind borders of mountain branch there was no inventory of the minerals left suitable for development. This refining of border of mountain branch is not its change and does not require registration of new mountain branch. Works on driving of these developments outside borders of mountain branch with further working off of the killed inventories shall be coordinated with the Gospromnadzor.

7. The companies shall have in necessary set the clearing and driving complexes, extraction, mining-transport machines and mechanisms, other technical means provided by the project and ensuring safety of conducting mining operations, the most complete, complex extraction of minerals from subsoil, protection of subsoil and the environment.

Actions for rational use and protection of subsoil shall be technically feasible (to have technology of the implementation), to meet safety requirements of conducting works and to be cost-efficient (from the level of ensuring return of costs). For input of the mountain company in action they shall answer the level of modern domestic and foreign technologies and the equipment, and also to provide marketing of all or most of consumers.
