1. This Procedure is developed in compliance of articles 13 and 24 of the Law of the Republic of Tajikistan "About the competition and restriction of monopolistic activities in the goods markets" and establishes the procedure, terms of hearing of cases about antitrust violations, and adoptions of decisions on them.
2. The authorized body performing the antimonopoly policy (further - authorized body) within the powers initiates and considers proceedings on antitrust violation. By results of hearing of cases makes decisions and issues instructions, obligatory for execution.
3. The basis for consideration by authorized body of cases on antitrust violations is:
- receipt from public authorities, local executive bodies of the government, self-government institutions of the settlement and village of the materials specifying availability of antitrust violation;
- statement of business entities and physical persons;
- detection of signs of antitrust violation by authorized body, in particular, not submissions of authentic documents and other information in compliance of article 14 of the Law of the Republic of Tajikistan "About the competition and restriction of monopolistic activities in the goods markets";
- the message of mass media specifying availability of signs of antitrust violation.
