1. General provisions

1. Rules of rendering services of telephone communication are developed according to the current legislation of the Republic of Tajikistan, and govern the relations between the subscriber (client) and the telecom operator on rendering services of telephone communication in the territory of the Republic of Tajikistan, contain the provisions obligatory for the parties in case of the conclusion of the service provision agreement of telephone communication. Rules provide protection of interests of users, and also telecom operators and are obligatory for execution in the territory of the Republic of Tajikistan.

2. Action of these rules does not extend to rendering services of telephone communication by the networks of mobile radiotelephone communication allocated with the communication networks for needs of management, defense, safety and protection of law and order created according to regulatory legal acts of the Republic of Tajikistan, and also the communication networks of intra production and technological appointment which do not have exit to telephone network public. Features of rendering services of telephone communication by systems of overland mobile service are regulated by other regulating documents.

3. For the purposes of these rules the following main terms are accepted:

- "subscriber payment system of services of telephone communication" - payment system of services in case of which the payment amount of the subscriber for certain (settlement) period of time (month, decade, etc.) is the constant which is not depending on amount of the actual received services;

- "subscriber" - physical person or legal entity with which the service provision agreement of telephone communication is signed with allocation of subscriber numbers;

- "subscriber number" - number selected to the subscriber in case of the conclusion of the service provision agreement of telephone communication according to which the subscriber device connected to telephone network in case of connection with it of other devices is identified;

- "the subscriber device (the terminal equipment) "the technical tool of forming of signals of telecommunication connected to subscriber lines for transfer or acceptance on communication channels of information (the telephone set, the fax, answering machine, the modem, etc.) set by the user

- "long distance communication" - telephone connection between the users who are in the territory of different subjects of the Republic of Tajikistan or different administrative areas of one subject of the Republic of Tajikistan (except areas as a part of the city);

- "the international telephone communication" - telephone connection between the user who is in the territory of the Republic of Tajikistan and the user who is in the territory of other state;

- "local telephone communication" - telephone connection between the users who are in limits of one settlement or administrative area;

- "telecommunications agency" - the legal entity irrespective of patterns of ownership presented services of electric communication to physical persons and legal entities as core activity;

- "telecom operator" - the organization irrespective of pattern of ownership or the individual entrepreneur, the having licenses for provision of services of telephone communication granted by the central executive body in the field of communication of the Republic of Tajikistan and rendering these services based on service provision agreements of telephone communication;

- "time payment system of services of telephone communication" - payment system in case of which the payment amount of the subscriber (client) for certain (settlement) period of time depends on time during which lines and constructions of telephone network for information transfer and receipt of other services of telephone communication were used;

- "user" - the physical person or legal entity having intention to order, or ordering or using services of telephone communication as based on the service provision agreement of telephone communication (the subscriber, the client), and in the absence of such agreement;

- "settlement period" - period of time for which shall be:

- "telephone connection" - establishment of the communication between two subscriber devices providing possibility of exchange of information;

- "telephone exchange" - the part of telephone network consisting of the equipment, controls and the alarm system thanks to which telephone connection is provided;

- "the provided telephone connection room" - the room in which the connected subscriber device according to the service provision agreement of telephone communication is established;

- "technical capability for the conclusion of the service provision agreement of telephone communication" - availability of vacant rooms at telephone exchange, subscriber lines and reservoir of systems of radio access taking into account the technological regulations installed by the central executive body in the field of communication of the Republic of Tajikistan;

- "electric communication (telecommunication)" - any transfer or acceptance of signs, signals, the written text, images, sounds on wire, radio - optical and to other electromagnetic systems.

4. Services of telephone communication are rendered based on the service provision agreement of telephone communication signed between the telecom operator and the subscriber (client). 5. Services of telephone communication are rendered with providing for all users of identical terms of service and payment taking into account privileges and benefits, stipulated by the legislation the Republic of Tajikistan and other regulatory legal acts. The messages concerning safety of human life at the sea, on the earth in air, in space, holding urgent actions in the field of defense, safety and protection of law and order in the Republic of Tajikistan, and also messages on major accidents, catastrophic crashes, epidemics and natural disasters use absolute priority.

6. During natural disasters, quarantines and other emergency situations the central executive body in the field of communication of the Republic of Tajikistan has the right of priority use of services of telephone communication, suspension of activities of any networks and means of communication irrespective of departmental accessory and pattern of ownership, temporary shutdown of telephone sets and other subscriber devices what the last shall be notified on.

7. The relations of telecom operators with users of services of telephone communication arising when rendering services in the territory of the Republic of Tajikistan are performed in state language or in Russian - as language of international communication. The conversation of users can take place in any language.

8. Telecom operators shall observe the mystery of the telephone negotiations and other messages, and also all data transferred on networks of telecommunication, to them relating.
