About application by courts of some regulations of the legislation on protection of copyright and the related rights
For the purpose of uniform understanding and the correct application in court practice of some regulations of the legislation on protection of copyright and the related rights, the plenary session of the Supreme Court of the Republic of Kazakhstan DECIDES:
1. The relations arising in connection with creation and use of works of science, literature and arts (copyright), statements, execution, soundtracks of transfers of the organizations of on-air and cable broadcasting are regulated by the Civil code of the Republic of Kazakhstan (further - group of companies), the Law of the Republic of Kazakhstan "About copyright and the related rights" (further - the Law) and other regulatory legal acts.
The legal acts of the Republic of Kazakhstan strengthening protection of copyright and related rights are applied if do not contradict the rules established by the international treaties ratified by the Republic of Kazakhstan.
Now the Republic of Kazakhstan is participant of the following international treaties regulating these legal relationship:
