2. Determine that:

in case of determination of the size of annual lease payments for use of the parcels of land which privatization in accordance with the legislation of the Russian Federation is not allowed and which are transferred to the organizations of atomic power industrial complex for lease agreements rates of the rent are subject to indexation taking into account the rate of inflation provided by the Federal Law on the federal budget for the next financial year and planning period;

if the size of annual lease payment for use of the corresponding parcel of land exceeds 50 percent of the amount calculated proceeding from the rate of the land tax established according to the Tax Code of the Russian Federation, the rate of the rent changes Federal agency on management of federal property based on the appeal of the relevant organization of atomic power industrial complex.
