1. Approve the enclosed Instruction on customs clearance of the goods and vehicles moved through customs border of the Republic of Kazakhstan.

2. To provide to the Customs Control Committee of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, and also to provide its publication in mass media.

3. Recognize invalid:

1) the order of the Chairman of the Agency of customs control of the Republic of Kazakhstan of September 3, 2003 No. 416 "About approval of the Instruction on customs clearance of the goods and vehicles moved through customs border of the Republic of Kazakhstan" (No. registered in the Register of state registration of regulatory legal acts 2517, published in the Bulletin of regulatory legal acts of the central executive and other state bodies of the Republic of Kazakhstan, 2004, Art. The instruction on customs clearance of the goods and vehicles moved through customs border of the Republic of Kazakhstan

1. General provisions

1. This Instruction on customs clearance of the goods and vehicles moved through customs border of the Republic of Kazakhstan (further - the Instruction), determines the sequence of actions of authorized officers of customs authorities in case of production of customs clearance from the moment of submission of the customs declaration and documents concerning the goods and vehicles moved through customs border of the Republic of Kazakhstan until release according to the declared customs regime.

2. Customs transactions on customs clearance are performed by the corresponding customs posts of territorial subdivisions of authorized body on areas, the cities of republican value, the capital and departments of customs clearance of customs, authorized to make actions on customs clearance (further - customs authorities), in the places of their arrangement and other places determined by authorized body.

3. This Instruction is applied in case of declaration of goods and the vehicles moved through customs border of the Republic of Kazakhstan and also in case of change of customs regime in case of representation:

the cargo customs declaration (further - GTD);

the statement used as GTD in the cases established by regulatory legal acts of the Republic of Kazakhstan.

4. Authorized officers of customs authorities when implementing the customs transactions and customs procedures established by the Customs code of the Republic of Kazakhstan (further - the Code) having the right to apply the following forms of customs control:

verification of the customs declaration, documents and data according to article 442 of the Code;

survey of goods and vehicles, customs goods inspection and vehicles, check of marking of goods special brands, drawing on them identification tags according to Articles 446, 447, 449 Codes.

5. In case of production of customs clearance, authorized officers of customs authorities put down the corresponding marks and stamps on customs and other papers, and also make the corresponding records on these documents and in their electronic copies according to the procedure established by the customs legislation of the Republic of Kazakhstan.

6. The customs clearance of goods according to this Instruction is performed by one authorized officer of customs authority (further - the authorized officer).

Transfer of GTD, documents and data to other officials of customs authority who are not participating in procedures of acceptance, registration, control of check of GTD and documents for the customs purposes and also issues of GTD, is prohibited.
