The government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation which are hereinafter referred to as with the Parties

recognizing the commonly accepted regulations and rules of international trade,

agreed as follows:

Article 1. The basic concepts applied in this agreement

For the purposes of this agreement the following terms are used:

"indirect taxes" - the value added tax (further - the VAT) and excises (the excise tax or the excise duty);

"zero rate" - VAT liability at the rate zero percent that means for taxpayers (payers) of the VAT the right to compensation (offsetting, return) from the budget of VAT amounts;

"taxpayers (payers)" - taxpayers (payers) of taxes, charges and duties of the State Parties of custom union;

"goods" - any personal and real estates realized or intended for realization, all types of energy;

"work" - activities which results have material expression and can be implemented for requirements satisfaction of the organization and (or) physical persons;

"service" - activities which results have no material expression transfer, provision of patents, licenses, trademarks, copyright or other rights are implemented and consumed in the course of implementation of these activities, and also;

"commodity export" - commodity exportation, realized by taxpayers (payers), from the territory of one State Party of custom union on the territory of other State Party of custom union;

"commodity import" - commodity importation by taxpayers (payers) on the territory of one State Party of custom union from the territory of other State Party of custom union;

"competent authorities" - the Ministries of Finance, tax and customs authorities of the State Parties of custom union.
