About some measures for simplification of procedure for making of notarial actions

1. Determine that:

1.1. persons who addressed for making of notarial actions submit to the notary the documents proving their identity, capacity to act of citizens (civil capacity to act), legal capacity of legal entities, powers on making of such actions from name and for the benefit of other persons.

Other data and (or) documents necessary for making of notarial actions, the notary will independently request state bodies and other organizations of the Republic of Belarus, except for data and (or) documents which issue requires pronouncement of the court decree.

The data and (or) documents issued by competent authorities of foreign states are represented to the notary by persons who addressed for making of notarial actions, and in the cases provided by legal acts or international treaties of the Republic of Belarus, - are requested by the notary.

Reclamation of the data and (or) documents necessary for making of notarial actions is made by the notary no later than the day following behind day of the request of person for making of such actions and if the legislation provides payment for issue of these data and (or) documents, - no later than the day following behind day of representation by person to the notary of the document confirming introduction of payment for their issue. The specified document goes the notary to state bodies and other organizations of the Republic of Belarus along with request about submission of the data and (or) documents necessary for making of notarial actions;

1.2. the data and (or) documents necessary for making of notarial actions shall be provided by state bodies and other organizations of the Republic of Belarus at the request of the notary to two weeks from the date of its obtaining.
