About application of the Economic Procedure Code of the Republic of Belarus in case of cost allocation, connected with consideration of the case in economic court

Plenum of Supreme Economic Court of the Republic of Belarus for the purpose of the correct application of the economic procedural legislation in case of cost allocation, connected with consideration of the case in economic court, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges, decides to make the following explanations.

1. According to Articles 125, 126 Economic Procedure Codes of the Republic of Belarus (further - HPK) the costs connected with consideration of the case belong to court costs and consist from:

the sums of money which are subject to payment to experts, specialists, witnesses and translators;

expenses on production of survey of proofs in the place of their stay;

other expenses recognized by economic court necessary.

2. According to article 132 HPK in case of giving by party litigant or the third party who declared independent requirements, petitions for purpose of examination or for need of challenge in the judicial session of the specialist and (or) witness, sums of money which are subject to payment to experts, specialists and witnesses previously shall be brought into the corresponding account of economic court by the applicant of the petition.

If such petition is declared by both parties or the challenge of specialists and witnesses, purpose of examination and other actions which are subject to payment are carried out at the initiative of economic court, necessary sums of money are granted by the parties in equal parts into the corresponding account of economic court.
