For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed technical regulation "Requirements to Safety of Buildings, Constructions and Adjacent Territories" (further the Technical regulation).

2. Provide to the central and local executive bodies reduction of the regulatory legal acts in compliance with the Technical regulation approved by this resolution.

3. This resolution becomes effective after six months from the date of official publication.

Technical regulation "Requirements to Safety of Buildings, Constructions and Adjacent Territories"

1. Scope

1. This Technical regulation establishes requirements to safety of the buildings realized in the market and put into operation, constructions and the adjacent territories (further - buildings (construction)), their designings shown to processes, construction, operation and post-utilization.

2. Objects of technical regulation of this Technical regulation are:

1) the design estimates realized in the market on buildings (constructions) (further - the project) created at stage of their designing;

2) the engineering construction procedures performed by subjects of the market for construction, reconstruction, restoration, expansion, modernization, upgrade, capital repairs of buildings (constructions);

3) their constructions realized in the market and put into operation of the building (construction) after completion of stage;

4) the processes of operation of buildings (constructions) performed by subjects of the market for the purpose of their use on functional purpose;

5) the engineering procedures of stage of post-utilization performed by subjects of the market for dismantle and demolition of buildings (constructions) after the termination of their operation with simultaneous recovery and recycling of the regenerated elements (designs, materials, the equipment), and also conversion of the elements and waste which are not subject to regeneration.

3. Requirements of this Technical regulation do not extend to the objects of technical regulation specified in Item 2, during the periods of military or extraordinary provisions in all territory of the Republic of Kazakhstan or in its certain areas, and also in cases of dangerous impacts buildings (constructions) as a result of emergency situations of natural and technogenic nature.

4. Dangerous factors (risks) which it is necessary to avoid in the buildings (constructions) realized in the market and put into operation concerning probability of damnification of life or to health of the person are:

1) sliding in case of contact with horizontal and inclined surfaces on transits of the person within the building (construction);

2) availability of dangerous ledges, biases, dredging, ledges, apertures and other similar factors on transits of the person within the building (construction), capable to lead to possibility of its fall;

3) the availability of ice formations, the wrong placement or dangerous condition of elements of green plantings, violations and defects of construction materials, designs and the equipment capable to make shock impact per capita within the building (construction);

4) availability of the hot or strongly cooled surfaces, liquids, gases, the air masses of technogenic nature capable to cause burn or frostbite to the person within the building (construction);

5) defeat by electric current because of availability of the unprotected electroconductive elements within the building (construction);

6) potential of explosion of the materials used in construction, products and designs, the equipment and other elements within the building (construction), capable to do harm to health of the person or wound, incompatible with life;

7) the noise level exceeding the established normative values within the building (construction) capable to do physical or mental harm to health of the person;

8) adverse microclimate of the habitat of the person because of unstable work or violations of systems of heating, ventilation and air conditioning of the building (construction);

9) availability of dangerous radiations (electromagnetic, radioactive and others) within the building (construction);

10) releases of the toxic gases capable to cause damage to health of the person;

11) availability in air of rooms of dangerous particles or gases;

12) the lowered fire resistance of the bearing elements which is not providing preserving their durability during the certain period of time in case of the fire;

13) easily flammable surfaces and elements, and also other factors promoting origin and intensive spread of fire and smoke in internal space of buildings (constructions);

14) lack of necessary fire-proof barriers (fire-proof walls, minimum necessary distances between adjoining buildings and so on);

15) dangerous operational processes in case of which the excessive amount of heat is generated that can be fire origin;

16) blocking up and other obstacles in the ways of evacuation intended on cases of emergency situations;

17) the obstacles in transits of fire and rescue groups which are not provided by the project to the building (construction) and in it;

18) collapse of the building (construction) or its part owing to the mistakes made on blueprint stage, constructions, operation;

19) deformations of inadmissible size and other damages of the building (construction) and its separate parts, and also equipment;

20) dangerous condition of the basic (bearing) elements of the building (construction) as a result of which in case of sudden and sharp movements of crust there is loss of stability of design;

21) availability of geophysical anomalies (geological faults, crossings of underground water flows, imposings of lines of global grids) in the territory of occupied by the building (construction);

22) availability of the video ecological danger doing harm to psychophysical health of the person;

23) the risk for life and health of the person caused by accidental events within the building (construction), disproportionate to the prime cause;

5. Dangerous factors (risks) which it is necessary to avoid in the buildings (constructions) realized in the market and put into operation concerning probability of damnification to the environment are:

1) violation of the mode of environmental management in case of construction, operation and post-utilization of buildings (constructions);

2) project placement of buildings (constructions) without ecological effects of their functional activities;

3) changes of the approved project of the building (construction) or cost of works to the detriment of environmental protection;

4) irrational use of natural resources in case of accomplishment of the installation and construction works and works connected with post-utilization;

5) construction on catchment areas of buildings (constructions) using potentially dangerous chemical and biological substances and radioactive materials leading to pollution and contamination of water objects in the production purposes;

6) construction of buildings (constructions) within the water protection zones and strips of water objects;

7) commissioning of buildings (constructions) of production appointment which are not provided with installations and the equipment on cleaning, neutralization and utilization of harmful waste, emissions of pollutants to the level of maximum permissible standard rates, control facilities of environmental pollution, without completion of the designed works on recultivation of lands and improvement of the adjacent territories;

8) lack of sanitary cleaning, neutralization, utilization, warehousing, safe removal, conversion and burial of the industrial and household wastes which are formed in case of operation of buildings (constructions).

6. Objects of technical regulation of this Technical regulation are identified for the purpose of application of its requirements for the following rules:

1) the project is identified by types and structure of town-planning and architectural and construction documentation depending on object and constructions are more whole and it is developed according to the customer's task for designing and specifications of the service providers on engineering and utility support around expected construction constituted according to the procedure, established by the legislation in the field of architectural, town-planning and construction activities;

2) construction processes for creation of all types of three-dimensional, plane and linear capital objects (buildings, constructions and their complexes, communications), including the processing and engineering equipment relating to them, are identified by types of installation and construction works and are implemented according to the procedure, established by the Civil code of the Republic of Kazakhstan and the legislation in the field of architectural, town-planning and construction activities;

3) the building (construction), implemented in the market and put into operation, are identified on functional purpose according to the design estimates or technical data sheet according to the Civil code of the Republic of Kazakhstan and the legislation in the field of architectural, town-planning and construction activities;

4) processes of operation of buildings (constructions) depending on their functional purpose are identified on the basis of provisions of legal acts of the Republic of Kazakhstan and this Technical regulation;

5) engineering procedures of post-utilization of buildings (constructions) are identified according to the procedure, established by the legislation in the field of architectural, town-planning and construction activities and solutions of local executive bodies.

7. Identification of objects of technical regulation of this Technical regulation is performed in the following cases:

1) in case of creation and the conclusion of contracts for order fulfillment on development of the design estimates;

2) in case of realization by the subject of the market of the design estimates for implementation of construction;

3) in case of creation and the conclusion of works agreements on implementation of installation and construction works;

4) in case of realization in the market of the operated buildings (constructions) passing from one owner to another;
