About approval of the Instruction about procedure for the organization of work on labor protection in the organizations of inland water transport

Based on the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:

1. Approve the enclosed Instruction about procedure for the organization of work on labor protection in the organizations of inland water transport.

2. Declare invalid the order of the Ministry of Transport and Communications of the Republic of Belarus of May 3, 1997 No. 99-Ts "About enforcement of the Regulations on the organization of work on labor protection at the companies of river transport".

3. This resolution becomes effective from the date of its official publication.

Chapter 1. General provisions

1. The instruction about procedure for the organization of work on labor protection in the organizations of inland water transport (further - the Instruction) is developed based on the Labor code of the Republic of Belarus, the Concept of public administration by labor protection in the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of August 16, 2005 No. 904 (The national register of legal acts of the Republic of Belarus, 2005, No. 129, 5/16410), other regulatory legal acts concerning labor protection.

2. The instruction extends to the state organizations of inland water transport which are under supervision of the Ministry of Transport and Communications of the Republic of Belarus (further - the organizations of water transport), and is directed to accomplishment by heads and specialists of the organizations of water transport of obligations in labor protection, realization of state policy in this area, providing healthy and safe working conditions of employees of these organizations occupied with performance of works on inland waterways of the Republic of Belarus (further - workers).

3. Tasks of the organization of work on labor protection in the organizations of water transport are:

improvement of conditions and labor protection, elimination or bringing to admissible sizes of dangerous and harmful production factors, risks of death and injuring of workers;

prevention of accidents and incidents, injury prevention and incidences on production;

ensuring control of observance of requirements of labor protection.

4. Realization of tasks of the organization of work on labor protection in the organizations of water transport provides:

creation according to the legislation of service (appointment of the responsible specialist) on labor protection;

distribution of obligations and responsibility of officials on labor protection;

preparation of projects, approval of the local regulatory legal acts regulating monitoring procedure behind compliance with law of the Republic of Belarus about labor protection;

the organization and implementation of constant control behind labor protection, observance of regulatory legal acts on labor protection;

professional selection, timely carrying out training, instructing, examination and advanced training of workers concerning labor protection;

development and accomplishment of programs, plans, actions for improvement of conditions and labor protection, to injury prevention and occupational diseases;

analysis of condition of conditions and labor protection, reasons of accidents, industrial traumatism, occupational diseases;

organization and carrying out work on prevention of violations by workers of safety requirements and occupational health, promotion of questions of labor protection, best practices in area of labor protection.

5. The officials guilty of violation of the law on labor protection, job descriptions, regulations on the structural divisions determining obligations and responsibility by labor protection bear responsibility according to the legislation.

Chapter 2. Organizational structure, distribution of job responsibilities on ensuring labor protection in the organizations of water transport

6. The common directorship work on ensuring labor protection, its direct carrying out in the organization of water transport (its structural division) are assigned to the head of the organization of water transport or the head of the isolated structural division (further - branch of the organization of water transport) who are granted the right of the conclusion and the termination of employment contracts (contracts) with workers.

7. For the organization of work and control for labor protection the head of the organization of water transport enters position of the labor protection specialist or creates security service of work from among persons having necessary preparation and determines its quantitative structure (department, bureau, other structural division) according to the Standard regulations on security service of work of the organization approved by the resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of May 24, 2002 No. 82 (The national register of legal acts of the Republic of Belarus, 2002, No. 89, 8/8286).

In case of the number of staff of workers of 250 and more people the number of security service of work is determined according to the standard rates of number of labor protection specialists established by the Ministry of Labour and Social Protection of the Republic of Belarus.

In the organizations of water transport where the established post of the labor protection specialist is not provided, its obligations are carried out by persons designated by the order of the head of the organization of water transport.

8. The main objectives of the labor protection specialist (security service of work) are:

control of observance of requirements of acts of the legislation of the Republic of Belarus, technical regulatory legal acts and local regulatory legal acts on labor protection;

coordination of activities of officials of structural divisions of the organization of water transport for providing healthy and safe working conditions;

organization of training and examination of workers for labor protection;

informing and consultation of officials and employees of the organization of water transport for labor protection;

implementation of the best practices on safety and occupational health, labor protection promotion.

The head of the organization of water transport taking into account functions and role of structural divisions, officials in industry management system labor protection (further - OSUOT) and according to this Instruction determines their job responsibilities and powers in this area.

The job responsibilities of heads and specialists of the organization of water transport in labor protection provided by this Instruction shall be considered in case of development of job descriptions, regulations on structural divisions.

9. The head of the organization of water transport shall provide labor protection of workers, including:
