About realization of the imported natural gas in the territory of Ukraine

The Cabinet of Ministers of Ukraine decides:

1. Determine that:

since January 1, 2010 natural gas which arrives in gas-transport system of Ukraine under the external economic contracts and agreements of purchase sale the concluded predpriyatiyamiproizvoditel of nitrogen mineral fertilizers which list is approved by the order of the Cabinet of Ministers of Ukraine of June 3, 2009 N 880, is used by such companies only for satisfaction of own needs for amounts according to the year balance of receipt and distribution of natural gas which is approved by the Cabinet of Ministers of Ukraine;

since March 1, 2008 the imported natural gas is implemented in Ukraine by National joint stock company "Neftegaz of Ukraine" and its subsidiary company "Gas of Ukraine" on condition of carrying out by consumers absolute payment of the used natural gas;

in case when amounts of central and Central Asian natural gas which arrives in gas-transport system of Ukraine, is insufficient for requirements satisfaction of consumers of Ukraine, the National joint stock company "Neftegaz of Ukraine" uses resources of own natural gas which are stored in underground storage warehouses of its subsidiary company "Ukrtransgaz".

Oblige National joint stock company "Neftegaz of Ukraine" according to the Agreement on settlement of the relations in the gas sphere of January 4, 2006 to carry out settlings with the RosUkrEnergo AG company or Gazprom export private company for the central and Central Asian natural gas accepted on border with the Russian Federation proceeding from its price in 2008 of 179, of the 5th US dollar for 1 thousand cubic meters.
