About some measures for implementation of the investment projects financed by the external state loans and external loans attracted under guarantees of the Government of the Republic of Belarus

1. Determine that legal entities - the residents of the Republic of Belarus realizing the investment projects financed by the external state loans and external loans attracted under the guarantees of the Government of the Republic of Belarus included in the list of such projects approved by Council of Ministers of the Republic of Belarus:
1.1. when carrying out purchases of goods (works, services) for implementation of these investment projects has the right not to hold competitions (other types of procedures of purchases) if the international treaty, by the interbank agreement, the individual credit agreement or other document containing terms for crediting in case of attraction of the external state loans and external loans attracted under guarantees of the Government of the Republic of Belarus provides special requirements of the creditor to procedure for the choice of the supplier (the contractor, the contractor);
1.2. when importing to the territory of the Republic of Belarus of processing equipment and the spare parts to it intended for implementation of such investment projects are exempted from customs duties and the value added tax.
The list of processing equipment and spare parts to it with indication of investment projects for which implementation they are imported on the territory of the Republic of Belarus affirms Council of Ministers of the Republic of Belarus.
In case of inappropriate use of these of the equipment and spare parts to it customs duties and the value added tax are collected according to the legislation;
