About selection achievements of crops
This Law governs the relations arising in connection with creation, use and protection of selection achievements of crops on which patents are granted.
Selection of crops consists of complex of the selection actions directed to receipt of new plant varieties.
The new plant variety which irrespective of protectability is determined by the signs characterizing this genotype or combination of genotypes and differs from other plants of the same botanical taxon at least in one sign.
The grade can be provided by several plants, one plant, one or several parts of plant provided that such part or parts can be used for reproduction of plants of grade.
To new selection achievement it shall be appropriated by the name, offered by the applicant and approved by State commission on strain testing of crops and protection of grade under the Ministry of Agriculture of the Republic of Tajikistan which is hereinafter referred to as by State commission, and registered in the State register.
The name shall allow to identify selection achievement, to be short, to differ from the existing selection achievements of the same or close botanical type and easily recognizable.
In case of application for selection achievement in the Republic of Tajikistan and other states it shall have one name.
The name of selection achievement under certain circumstances can be changed with the consent of State commission.
The protected selection achievement shall be applied with that name which is registered in the State register of the protected selection achievements.
