About application of the Economic Procedure Code of the Republic of Belarus by hearing of cases in economic court of cassation instance
For the purpose of uniform application of the Economic Procedure Code of the Republic of Belarus by hearing of cases in economic court of cassation instance the Plenum of Supreme Economic Court of the Republic of Belarus, being guided by Articles 74, 75 Codes of the Republic of Belarus about judicial system and the status of judges, decides to make the following explanations.
1. According to Article 282 of the Economic Procedure Code of the Republic of Belarus (further - HPK) along with persons participating in case also persons who are not recruited in case have the right of cassation appeal of the court decrees of economic courts of the first and (or) appeal instances which took legal effect if about their rights and obligations the economic court accepted the court decree.
Persons who are not recruited in case, but about the rights and which obligations the court decree is accepted, have the right to make the writ of appeal irrespective of in what part of the court decree it is specified about the rights and obligations of these persons.
Persons specified in the paragraph the second this Item before submission of the writ of appeal have the right to get acquainted with case papers based on the written application containing specifying on file number and acceptance date of the court decree, and also on the rights and obligations concerning which the court decree is accepted. From the date of acceptance by economic court to production of the writ of appeal these persons have all rights and perform duties of persons participating in case.
