About fight against human trafficking
This Law determines legal, organizational basis of fight against human trafficking in Turkmenistan and is aimed at providing the state guarantees of personal freedom, protection of society against human trafficking.
In this Law the following basic concepts are used:
human trafficking - set of the actions connected with recruitment, purchase, sale, transportation within one or several countries, transfer from hand to hand or deduction of person or group of persons by threat of force or its application, involvement in debt bondage or other forms of coercion, stealing, deception, fraud, authority misuse or vulnerability of provision, adoption (adoption) in commercial purposes or by bribery in payment type or benefits for receipt of consent of person controlling other person and also the different ways containing actus reus for the purpose of operation;
the dealer in people - physical person or legal entity which independently or in group of persons makes any actions connected with human trafficking and also the official who the actions (failure to act) promotes human trafficking and equally does not interfere and does not resist to it though shall do it owing to the office powers;
the victim of human trafficking - person which was affected by human trafficking irrespective of whether there was consent of this person to transportation, the transfer, sale or other actions connected with human trafficking;
recruitment - employment, enrollment for any works, attraction to any activities, including illegal, involvement in structure of any organization, including organization which activities are prohibited by the law;
forced labor - any work or services which are required from the face under the threat of punishment or by other forms of coercion and for which this person did not offer the services voluntarily;
