About measures for strengthening of labor discipline
For the purpose of enhancement of the legislation concerning labor discipline, its strengthening, creation of conditions for the arranged transition to the market relations and stabilization of economy the Supreme Council of the Republic of Tajikistan decides:
I. Determine that the workers and employees allowing violations of labor discipline, absence without reasonable excuse, emergence at drunk work in condition of drug or toxic intoxication, or drinking of alcoholic drinks at work, can be transferred to other below-paid work for a period of one up to six months or are displaced to other lowest position for the same term. Dismissal of these workers at own will during this period not to be made; to the workers and employees who made absence without valid excuse the next leave is reduced by the number of days of absences, at the same time leave shall not be less than two business weeks (12 working days); to the workers and employees dismissed for systematic violation of labor discipline, absences without reasonable excuse, awards on new place of employment within year are paid in half size; to recognize the damage caused owing to absence as direct valid loss which is subject to compensation by workers and employees in complete size but not over average monthly earnings.
II. The heads of the companies, organizations, organizations and other officials suppressing the facts of making of absences and other violations of labor discipline, allowing payments to the worker of salary for days of absences, are punished by shift to the lowest position term from three months to one year, and in case of causing by these actions of material damage - bear financial responsibility in the amount of the caused damage, but not over two monthly average earnings.
III. This Law becomes effective from the moment of its acceptance.
