About some questions of court practice in case of the dispute resolution according to loan agreements

Having heard information on results of generalization of court practice on civil cases on contractual disputes of loan and the credit for 1999 - 2000, the Plenum of the Supreme Court of the Kyrgyz Republic notes that generally cases of the specified category were permitted by courts correctly taking into account the regulations of the current legislation and explanations containing in the resolution of the Plenum of the Supreme Court of the Kyrgyz Republic "About some questions of court practice in case of the dispute resolution connected with the conclusion and execution of loan agreements" of April 3, 1998. From among the studied cases decisions on every third case were appealed, are changed or cancelled by courts of appeal and supervising instances of the decision on every minor matter of this category.

By results of generalization the Plenum of the Supreme Court of the Kyrgyz Republic considers necessary to draw the attention of courts to the facts of the wrong application or non-use of some regulations of the substantive right regulating disputable legal relationship, noted in the overview of court practice.
