About terms of consideration of criminal cases by courts of the Kyrgyz Republic

Having considered results of studying of practice of observance by courts of terms of consideration of criminal cases, the Plenum of the Supreme Court of the Kyrgyz Republic notes that the majority of cases is considered by courts of the republic in the terms established by the law. Certain work on enhancement of the organization of legal procedure according to regulations of the new Code of Criminal Procedure is done.

At the same time separate courts allow violations of requirements of the procedural law on terms of consideration of criminal cases. The most frequent violations are allowed by courts of Chuy Region and the city of Bishkek where significant amount of cases is considered with violation of fixed terms.

Are basic reasons of violation of terms:

- untimely decision making on the arrived case according to the procedure, provided by the Art. of the Art. 244, of 245 Codes of Criminal Procedure of the Kyrgyz Republic, and also setting a date for the trial with violation of the terms provided by Art. 247 of the Code of Criminal Procedure of the Kyrgyz Republic that leads to adjournment of legal proceedings;

- cases when they contrary to requirements of Art. 252 of the Code of Criminal Procedure of the Kyrgyz Republic of case are appointed with violation of monthly term of consideration are frequent. Explicit violations of regulations of the procedural law when separate cases are left in courts without movement take place and are appointed to hearing in several months;
