About approval of the Regulations on procedure for use of fund of subsidizing of agricultural producers

In pursuance of provisions of article 5 of the Law on the government budget for 2008 N 254-XVI of November 23, 2007

The parliament accepts this resolution.

Art. 1. - Fund of subsidizing of agricultural producers in the amount of 270 million lei is distributed for administration and the order as follows:

1) to the Ministry of Agriculture and food industry 193 million lei, including:

a) 30 million lei - for production incentive of fruit landing material and creation of fruit plantings, from them 5 million lei - for creation of nuciferous plantings;

b) 4 million lei - for support of promotion and development of ecological agricultural production;

c) 50 million lei - for subsidizing of users of means of phytosanitary appointment (pesticides) and the means increasing fertility of the soil (mineral fertilizers);

d) 18 million lei - for subsidizing of risks insurance in agricultural industry;

e) 91 million lei - for stimulation of capital investments, including:

20 million lei - for stimulation of investments into production of vegetables in the closed soil, acquisition of the machinery and equipment for irrigation;

20 million lei - for stimulation of investments into acquisition of the equipment and installations for the purpose of equipment of the small and medium companies for conversion, drying and freezing of the fruit and vegetables located in the rural zone and also the companies for packaging and refrigerators;

8 million lei - for stimulation of investments into creation, recovery and upgrade of material and technical resources for cultivation and postharvest conversion of tobacco;

23 million lei - for stimulation of investments into recovery of the livestock sector;

20 million lei - for stimulation of investments into acquisition of agricultural machinery and stock;

2) to the state company "Moldresurse" - 20 million lei for stimulation of creation of machine and technological stations;

3) to the state agency "Apele Moldovei" - 7 million lei for covering of the expenses connected with water supply;

4) to the Ministry of Finance through the Main state tax authorities - 50 million lei for subsidizing of the agricultural producers delivering self-produced agricultural products in the territory of the country.

Art. 2. - Approve the Regulations on procedure for use of fund of subsidizing of agricultural producers stated in annex.

Art. 3. - Use in other purposes of the subsidies allocated according to this resolution, except for subsidies according to applications which were not granted in 2007 because of lack of finance and which are satisfied from fund of subsidizing of agricultural producers in 2008 according to the Provision approved by the Resolution of Parliament N15-XVI of February 9, 2007 is forbidden.

Art. 4. - This resolution becomes effective on January 1, 2008.

Regulations on procedure for use of fund of subsidizing of agricultural producers

Chapter I. GENERAL PROVISIONS

1. The regulations on procedure for use of fund of subsidizing of agricultural producers (further - provision) establish procedure for administration and use of fund of subsidizing of agricultural producers (further - fund) and the size of partial compensation of expenses on implementation of the types of agricultural activities provided by this provision.

2. Administration and the order fund is performed by the Ministry of Agriculture and the food industry and the Ministry of Finance by means of the Main state tax authorities, the state agency "Apele Moldovei" and the state company "Moldresurse" according to the current legislation and this provision.

3. Requirements of this provision extend on all physical persons and legal entity irrespective of the type of property and form of business registered in the procedure established by the current legislation and the business entities acting in the agricultural sector, except for concerning whom the procedure of insolvency is begun.

Chapter II. ADMINISTRATION of FUND

4. Within bodies of public management the profile commissions on consideration of petitions on allocation of financial resources from fund are established:

a) in structure of the profile commissions created within the central industry bodies of public management (further - the central profile commissions), representatives of the ministry, labor union, industry patronage and profile non-governmental organizations enter;

b) in structure of the profile commissions created within bodies of local public authority of the second level (further - the local profile commissions), representatives of agricultural managements, tax authorities, industrial trade union "Agroindsind", non-governmental profile organizations enter. The structure of the commissions affirms the chairman of the area.

5. Treats powers of the central profile commissions:

a) submission of offers on approval of funding plans and introduction of changes in them;

b) determination of priority of distribution of fund;

c) consideration at meetings of the documents submitted by applicants and adoption of relevant decisions;

d) control of correctness of calculations and distribution of fund;

e) ensuring transparency of distribution of fund by publication in mass media of the list of receivers of the help from the state with indication of type of the project for which financial resources, paid amounts and contact information of each receiver separately are allocated;

f) acceptance from the local profile commissions of documents of applicants and their check in 15-day time.

6. Treats powers of the local profile commissions:

a) check of packets of the supporting documents submitted by applicants and formulation of offers on subject of the request;

b) transfer of packets of the supporting documents submitted by applicants to the central profile commission;

c) check of accomplishment by receivers of the obligations;

d) creation of reports and their transfer to the central profile commission.
