1. Approve the enclosed Aviation rules of the Kyrgyz Republic "APKR-13 Investigation of aviation incidents and incidents".
2. Direct this order to state registration in the Ministry of Justice of the Kyrgyz Republic.
3. Determine that this order becomes effective from 01.07.2008 after state registration in the Ministry of Justice of the Kyrgyz Republic and subsequent its official publication.
4. Notify the Ministry of Justice of the Kyrgyz Republic on official publication of this order.
5. From 01.07.2008 to declare invalid the order of the Ministry of Transport and Communications of the KR No. 138 of 26.04.2000 "About approval of the Management on investigation of aviation incidents and incidents with civil aircrafts in the Kyrgyz Republic", registered in the Ministry of Justice of the Kyrgyz Republic of 17:05. 2000, registration No. 96.
6. Repeal the order of the Ministry of Transport and Communications of the KR No. 104 of 01.04.2008 "About approval of Aviation rules of the Kyrgyz Republic "APKR-13 Investigation of aviation incidents and incidents".
7. To impose control of execution of this order on the Deputy minister of transport and communications of the Kyrgyz Republic Mamataliyeva of A.M.

Aviation incident. The event connected with use of the aircraft which takes place since the moment when any face is raised aboard with intention to make flight, till the moment when all being onboard person left the aircraft, and during which:
(a) any face sustains bodily harm from the death or serious bodily harm as a result:
- stays in this aircraft; or
- direct contact with any part of the aircraft, including the parts separated this aircraft; or
- direct impact of stream of gases of the jet engine;
unless bodily harms are sustained as a result of the natural reasons, put to themselves, or put with other persons or when bodily harms are put to the free riders disappearing out of zones where access to passengers and crew members is usually open; or
(b) the aircraft sustains damage or there is destruction of its design therefore:
- design durability is broken, technical or flight characteristics of the aircraft worsen; and
- usually extensive repair or replacement of the damaged element is required;
except as specified refusal or damage of the engine when only the engine, its cowls or auxiliary aggregates is damaged; or when only air screws, zakontsovka of wing, antennas, pneumatics, brake mechanisms, fairing or when in covering there are small dents or holes are damaged; or
(c) the aircraft is missing or it appears in such place where access to it is absolutely impossible.
Note 1. Only for the purpose of uniformity of statistical data bodily harm as a result of which within 30 days from the moment of incident there came death is classified by International Civil Aviation Organization (ICAO) as bodily harm from the death.

(d) it is connected with damage of any internal body; or
(e) it is connected with receipt of burns of the second or third degree or any burns affecting more than 5% of surface of body; or
(f) it is connected with the confirmed fact of impact of infectious substances or the striking radiation.
Serious incident. Incident which circumstances are specified that aviation incident nearly took place.
Adviser. Person designated by the state owing to availability at it the corresponding qualification for the purpose of assistance to the authorized representative of this state in investigation.
Representative for investigation. Person to whom owing to availability at it the corresponding qualification the organization and conducting investigation, and also control of its course are charged.
Note. Nothing in the stated above determination is considered as interfering appointment of the representative for investigation in structure of the commission or other body.
Authorized representative. Person designated by the state owing to availability at the first the corresponding qualification for participation in the investigation made by other state.
Operator. The person, the organization or the company which are engaged in operation of aircrafts or offering the services in this area.
