About amnesty in connection with the 50 anniversary of the Council of Europe

Considering exclusive role of the Council of Europe in the democratic reforms undertaken in our country and main objective of these reforms, for the purpose of application recognized as all in Europe of universal values in the state construction and public life of Azerbaijan, capture for basis of humanity and traditions of philanthrophy as one of the main tasks in this area, providing according to the European standards of criminally liable policy and based on educational value of release from punishment, wishing correction of the condemned persons and their entry into free society, in connection with the 50 anniversary of the Council of Europe, Millie the Majlis of the Azerbaijan Republic decides:

Chapter 1. The group of people to which amnesty is applied

I. Exempt from punishment by imprisonment of the following convicts irrespective of the punishment term determined by it:

1) persons who were involved in fights for protection of sovereignty and territorial integrity of the Azerbaijan Republic, and also against fascism during World War II, and close relatives been killed in these battles or missing persons (the grandfather, the grandmother, parents who adopted the native, nonnative brothers and sisters, the husband wife, children adopted grandsons);

2) the faces repressed in the period of the former USSR, and then rehabilitated by the decision of the relevant authorities and their close relatives;

3) persons deported from Armenia as a result of policy of ethnic cleaning and genocide in 1948 - 1953 and 1988;

4) the persons who were taking part in liquidation of the Chernobyl accident, and rendering them guardianship (if guardianship is established in the procedure provided by the law);

5) persons which became disabled people or close relatives of persons which became shekhida in the tragedy on January 20, 1990;

6) persons which became disabled people or close relatives of persons which became shekhida in genocide of Khojali;

7) persons running from native lands and by force the parts of the territory of Azerbaijan moved as a result of occupation in 1988-1993;
