About protection of the state secrets

This Law determines the legal basis of protection of the state secrets in activities of state governing bodies of Turkmenistan, the companies, organizations, organizations of all patterns of ownership, military forming, officials and citizens in all territory of the state and beyond its limits.

Section I. General provisions

Article 1. Concept of the state secrets

The state secrets - the data which are stored and moved on any kinds of data carriers, affecting defense capability, safety, economic and political interests of Turkmenistan, state-controlled - and limited by the special lists and rules developed on the basis of the Constitution of Turkmenistan and this Law.

Article 2. Categories of the state secrets

The state secrets of Turkmenistan are subdivided into the state and office secrets.

Data which disclosure can make negative impact on high-quality condition of military, economic capacity of the state are the state secret or entail other heavy effects for defense capability, homeland security, economic and political interests of Turkmenistan. Data in the field of production, managements, science and technology which disclosure can cause damage to interests of Turkmenistan are official secret.

Article 3. Obligation on protection of the state secrets

Protection of the state secrets - obligation of all state bodies having them, the companies, organizations, the organizations, military forming, and also officials and citizens. Carrying out any works with use of the state secrets is performed only after taking measures to their protection.
