In pursuance of part 11 of article 112 of the Federal law "About Enforcement Proceeding" Government of the Russian Federation decides:

Approve the enclosed Rules of return to the debtor of performing collection.

Rules of return to the debtor of performing collection

1. These rules determine procedure for return to the debtor of performing collection.

2. Performing collection returns to the debtor in full in case of cancellation of court resolution, the act of other body or the official based on which the executive document, the executive document, the resolution of the judicial police officer-contractor on collection of performing collection, except as specified, provided by part 5.1 of article 112 of the Federal law "About Enforcement Proceeding" was issued.

Performing collection returns to the debtor in case of pronouncement by court of the decision on release from collection of performing collection.

Performing collection also returns to the debtor partially in the amount of the amount which is excessively collected from it in case of pronouncement by court of the decision on reduction of the amount of performing collection.

3. Return of performing collection is performed based on the application submitted by the debtor in structural division of Federal Bailiff Service or in structural division of territorial authority of Federal Bailiff Service in which performing collection was collected.
