Government of the Russian Federation and Government of the Republic Georgia,

aiming at development of trade and economic cooperation between the Russian Federation and the Republic Georgia on the basis of equality and mutual advantage,

proceeding from the sovereign right of each Contracting Party to pursue independent external economic policy, to provide accomplishment of the corresponding international obligations and realization of the proclaimed intentions,

intending to promote creation of single commodity market, services, the capitals and labor power,

wishing to promote creation of proper conditions for forming of custom union between both countries,

agreed as follows:

Article 1

1. Contracting parties do not apply the customs duties, taxes and fees having equivalent action for import and commodity export, one of Contracting Parties occurring from customs area and intended to delivery to customs area of other Contracting Party. Features of application of the mode of trade between both countries according to the approved nomenclature of goods are drawn up by the annual Protocols which are integral part of this agreement.

2. For the purposes of this agreement and for its action the goods occurring from the territory of Contracting Parties are understood as goods:

a) completely made in the territory of Contracting Parties;

b) undergone to processing in the territory of Contracting Parties with use of raw materials, materials and components origin from the third countries, with change with respect thereto the accessory on classification of the Commodity nomenclature of foreign economic activity (Commodity Nomenclature of Foreign Economic Activity) based on the Harmonized commodity description and coding system and the Combined tariff and statistical nomenclature of the European Economic Community, proceeding from the four first signs;

c) made with use specified in the Item of raw materials, materials and components provided that their aggregate value does not exceed the fixed share of export price of implementable goods.
