This Law determines tasks, the principles, content and procedure for the operational search activities performed in the territory of Turkmenistan and installs system of legal guarantees of legality in case of its carrying out.
Operational search activities are the public and secret activities of representatives on that this Law of state bodies within their competence performed in the form of investigation and search operations for protection of life, health, the rights and personal freedoms, property, safety of society and the state from criminal encroachments.
The operational search action is separate public or secret action of the body performing operational search activities for accomplishment of the tasks determined by this Law.
Main objectives of operational search activities:
- the prevention, suppression and disclosure of crimes, and also identification of persons which prepare them make or made;
- implementation of search of persons disappearing from the bodies of inquiry, investigation and court evading from criminal penalty and compensation of the damage caused by crime, missing citizens;
- identification, the prevention and suppression of prospecting subversive activities of special services of foreign states and the international organizations against Turkmenistan;
- safety of the President of Turkmenistan and other protected persons;
- ensuring protection of frontier;
- ensuring safety of the data which are the state secret;
- safety of the officials performing operational search activities and the citizens involved in preparation or conducting investigation and search operations.
