About approval of Aviation rules of the Kyrgyz Republic of APKR-9 "Simplification of formalities"

According to articles 2 and 179 of the Air code of the Kyrgyz Republic, I order:

1. Approve the enclosed Aviation rules of the Kyrgyz Republic APKR-9 "Simplification of formalities".

2. Direct this order to state registration in the Ministry of Justice of the Kyrgyz Republic.

3. Determine that this order becomes effective after state registration in the Ministry of Justice of the Kyrgyz Republic and from the date of its official publication.

4. Notify the Ministry of Justice of the Kyrgyz Republic on official publication of this order.

5. Declare invalid the order of the Ministry of Transport and Communications of the Kyrgyz Republic of May 30, 2008 No. 178 "About approval of Aviation rules of the Kyrgyz Republic of APKR-9 "Simplification of formalities".

6. I reserve control of execution of this order.

PREFACE

These Aviation rules of the Kyrgyz Republic - APKR-9 (further - Rules) are developed based on article 2 of the Air code of the Kyrgyz Republic.

The name of Rules is based on the name specified in Item (i) of article 2 of the Air code of the Kyrgyz Republic. Numbering of Rules matches with sequence number of Item (i) of article 2 of the Air code of the Kyrgyz Republic.

In case of development of these rules as the main document of International Civil Aviation Organization (ICAO) Application 9 to the Convention on international civil aviation (The Chicago convention), the edition 12th which became effective 24.11.05 and including the amendment No. 20, which became effective 15.03.07 is used.

CHAPTER 1. DETERMINATIONS AND GENERAL PROVISIONS

A. Determination of terms

Airline. Any company performing regular international air traffics or offering the services in this area.

Baggage. The personal belongings of passengers or crew transported onboard the aircraft under the agreement with the operator.

Onboard equipment. Objects, including means of first aid, crash equipment, dining and saloon facilities, held for use onboard the aircraft during flight, but not spare parts or bortpripasa.

Bortpripasa (accessory) mean:

(a) bortpripasa (accessory) which are taken out;

(b) bortpripasa (accessory) spent.

Bortpripasa (accessory) taken out. Goods, held for sale to passengers and crew members for the purpose of their carrying out from aircraft board.

Bortpripasa (accessory) spent. The sold or not sold goods intended for consumption by passengers and crew onboard the aircraft and the goods necessary for operation and maintenance of the aircraft, including fuel and lubricants.

Temporary import. Customs regime in case of which some goods can be imported on customs area with conditional full or partial release from import duties and taxes; such goods shall be imported for specific purpose and are subject to the return export within the established period of time in steady-state condition, except changes owing to the natural wear caused by their use.

Unloading. Removal of loads, mails, baggage and bortpripas from aircraft board after its landing.

Documents of operators of aircrafts. Commander of the aircraft. The pilot having qualification mark of the commander of the aircraft in the certificate and appointed the operator or, in case of aircraft of general purpose, the owner of the aircraft to carry out obligations of the commander and to be responsible for safe accomplishment of flight.

Control of drugs. The measures taken for control of illicit movement of drugs and psychotropic substances by air.

Person without proper documents. Person who makes or tries to make trip:

(a) with the overdue travel document or the invalid visa;

(b) with false, counterfeit or changed by the travel document or the visa;

(c) with the travel document or the visa of other person; or

(d) without travel document or the visa if it is required.

Person without the right to entrance. Person to whom by the relevant authorities it is refused or will be refused the right to entry into the state.

International airport. Any airport allocated with the state in the territory for acceptance and sending the aircrafts which are carrying out the international airborne transportations in which boundary, customs, immigration, sanitary, quarantine and similar procedures are performed.

Actions for direct transit. The special events approved by the relevant state authorities as a result of which the aircrafts (and their loading) making short-term stop when following transit through the territory of this state can be under direct supervision of these bodies.

Land equipment. The special devices used for maintenance, repair and servicing of aircrafts on the earth including the test equipment and the equipment for load handling and servicing of passengers.

Beginning of trip. Item in which person began the trip, apart from the airport at which it made stop in case of direct transit, following either direct, or connection flight if it did not leave zone of direct transit of this airport.

Unclaimed baggage. The baggage which arrived to the airport and was not received or demanded by the passenger.

Unknown baggage. Baggage which arrived to the airport with luggage label or without luggage label and was not received or identified by the passenger.

Unaccompanied baggage. Baggage which is transported as load on another or on the same aircraft on which there is person which is its owner.

Equipment for safety. Special devices, held for use separately or as part of system for prevention or detection of acts of illegal intervention in activities of civil aviation and its services.

Open zone. Part of the territory of the state where any imported goods, from the point of view of import duties and taxes, usually are considered as being out of customs area.

Risk for health of the population. Probability of event which can adversely affect human health, with paying of special attention to risk which can extend in the international scales or represent serious and direct threat.

Dining and saloon facilities. Objects either one-time, or reuse, used by the operator of the aircraft for provision of servicing during flight, in particular for food and ensuring convenience of passengers.

Customs clearance of goods. Accomplishment of the customs formalities necessary for release of goods for internal use in the state, commodity export or their room under other customs regime.
